It is a delicate balance to strike for judges.

If they make it too easy for the abused, then anyone can just say "I was abused" in a matrimonial dispute to screw the other side.

On the other hand, it is often quite hard to prove something that happened if you do not have evidence other than your words (keep in mind physical injuries could and have been faked by people in the past). Most judges are aware of this barrier.

Most of the time, it comes down how the judge feel that day and which side (or their lawyer) is more persuasive/sympathetic. Not ideal, but what can you do.

Difficult cases to prosecute. Not least because of how controlling and manipulative abusers are.

The reluctance of prosecutors to pursue cases that aren't a sure thing is also a big factor.

And the abuser says he didn't abuse her, and there is no evidence beyond some spicy text messages and her friends saying he's a dick. You can't really do a whole lot with that legally.

The problem is, she, if it is a she, in this scenario, is already a victim, and the abuser knows that.
That is what they exploit.

It is at the point when The Victim does not press charges that the cycle continues.
Long story short, The Victim is used to be treated like shit, and just assumes it's their lot in life.

It's a horrible thing.
