I understand the family's concerns, but I would have pushed for murder charges if that was my family member. Unfortunately, I also see their point when the state has SYG laws. They were in a tough position and took the surer thing.

At every family Christmas, there will be a present under the tree for Danielle Frasier's grand-nephew labeled "from Uncle Dakota."

Frasier's son, 23-year-old Dakota Toepfer, never got a chance to hold his infant nephew before he was shot to death May 7. The gunman, Joshua Taylor, 21, was charged with murder and pleaded guilty to voluntary manslaughter. On Tuesday, he was sentenced to serve up to 20 years in prison with a mandatory minimum of five years, as well as pay $150,000 in restitution, as required under Iowa law.

Court records have contained few details about the circumstances of the shooting, but Toepfer's family said he intervened in an argument to protect his sister-in-law, Makayla Grasty, and was wearing nothing but his boxers when Taylor opened fire, shooting him seven times in the front and back.

In his victim impact statement at Tuesday's sentencing, Lakota Malone, Grasty's husband and Toepfer's brother, called Taylor a "coward" and accused him of "hiding behind your gun" when nobody was threatening his safety.

Frasier said the sentence is less than the family think Taylor deserves, but that they agreed to the plea deal in part because they feared Taylor might argue his actions were justified under Iowa's stand-your-ground law. Now, she said, her family has to learn how to grieve, and how to heal.

Taylor's defense attorneys did not respond to a message seeking comment.

Toepfer had struggled with addiction and done stints in prison and lived homeless in Missouri before returning to Iowa in January, Frasier said. He had gotten sober, had a good job in construction and was saving money for a new truck.

"This was the best place he'd ever been in, was right before he was killed," Frasier said.

Malone in his statement said that "for the first time in his life, everything was falling into place" for Toepfer, who he called "one of the nicest, coolest, understanding dudes in the world."

"He had everything going for him, and you took it all away," he told Taylor.

Frasier said Taylor's sentence doesn't feel like justice, but that she's glad he will serve some time instead of having the chance to get off entirely.

"At least he got something out of it," she said. "He's not walking free to go out and kill another person."

That leaves her family to mourn and try to move on. In addition to Christmas, she said, they plan to celebrate Toepfer's birthday each year, support each other and keep his memory alive. At this point, though, she said, she doesn't know what healing will look like.

"I have two kids that haven't even had a chance to grieve. They don't know how to grieve their brother," she said. "... I watched my nieces and nephews. They're just the same way: they don't know how to deal with it."

One thing Frasier said she plans to do is tell her son's story and advocate for changes to the stand-your-ground law that she believes made it harder to prosecute his killer.

"That way things can get changed that need to change," she said.

Rep. Marjorie Taylor Greene, R-Ga., lashed out at House Freedom Caucus members on Thursday after nearly two dozen Republicans voted to shoot down her attempt to censure Rep. Rashida Tlaib, D-Mich.

Greene went after the 23 Republicans who voted to kill her resolution, which Greene forced a vote on over Tlaibs criticism of Israel. Our country is in the worst crisis in its [sic] history in every category and the Democrats are full blown communists and Republicans cant even censure Rashida Tlaib,

Greene wrote in a post on X, formerly Twitter. Conservatives on this list hide behind excuses with their white wigs on and quote the constitution.

Rep. Chip Roy, R-Texas, a fellow MAGA Republican and member of the far-right House Freedom Caucus, criticized Greenes feckless resolution as deeply flawed and filled with factually unverified claims including Greenes claim that Tlaib led an insurrection. We should not continue to perpetuate claims of 'insurrection' at the Capitol and we should not abuse the term now, Roy said in a statement.

Greene fumed at Roy, complaining that he voted to kick me out of the freedom caucus, but keep CNN wannabe Ken Buck and vaping groping Lauren Boebert and you voted with the Democrats to protect Terrorist Tlaib.

Roy shot back at Greene, telling The Hills Mychael Schnell that Greene should go chase so-called Jewish space lasers if she wants to spend time on that sort of thing.

Greene fired back again on X/Twitter: Oh shut up Colonel Sanders, youre not even from Texas, more like the DMV. Chip Roys career exist [sic] of working for politicians, working for campaigns for politicians, and being a politician himself. Unity Party all the way! Which is why you will never hold anyone accountable.

https://www.cnn.com/2023/10/31/economy/national-association-of-realtors-commissions-high/index.html

A Missouri jury on Tuesday found the National Association of Realtors, a real estate industry trade group, and some residential brokerages liable for nearly $1.8 billion in damages after determining they conspired to keep commissions for home sales artificially high.

The lawsuit covered home sales that took place between April 2015 to June 2022.

We view it as a tremendous day of accountability for these companies, Michael Ketchmark, the lead attorney for the plaintiffs, told CNN.

Despite the verdict, the matter is still far from being resolved.

This matter is not close to being final. We will appeal the liability finding because we stand by the fact that NAR rules serve the best interests of consumers, support market-driven pricing and advance business competition, NAR president Tracy Kasper said in a statement after the verdict was announced.

However, she said NAR cant speak to the specifics to its basis of appeal until it is filed. In the interim, we will ask the court to reduce the damages awarded by the jury, Kasper added.

Warren Buffetts Berkshire Hathaway-owned HomeServices of America and two subsidiaries, as well as Keller Williams Realty, were among the other real estate groups the jury found guilty of conspiring.

A spokesperson from HomeServices told CNN the company is disappointed with the courts ruling and intends to appeal.

Todays decision means that buyers will face even more obstacles in an already challenging real estate market and sellers will have a harder time realizing the value of their homes, the spokesperson said.

Keller Williams did not immediately respond to CNNs request for a comment.

Ketchmark said groups like HomeServices are claiming this because theyre desperate to hang on to the system that they have rigged against everyone.

They made that same argument in court for the last couple of weeks and it took a jury all of two and a half hours to disregard it, he said.

The appeals process could take up to three years, said Jaret Seiberg, a housing policy analyst at TD Cowen. The losing party he said will likely attempt to have the case tried by the Supreme Court.

But Tuesdays verdict does not mean buyer commissions are a thing of the past, he said.

[story continues]
