Saying someone is bad at their job is, not what Id argue, abusive as per our ToS. To that effect, if one were to dispute a moderation under the grounds of I meant they were bad at their job by saying incompenent I would likely vote to overturn the moderation.
If, however, incompetence were to be an intelligence based insult, that could be inferred to be potentially abusive and against ToS.
