without getting into too much, the police report confirmed that the gun fired automatically once inside the police station when they were testing it.

yes they did some other tests that destroyed the gun. they probably did it on purpose because they were 100% trying to manufacture a conviction in this instance.

...Yeah, this seems like a pretty big deal. If police and prosecutors were literally withholding evidence, and destroyed the gun, as stated above, then... That's a problem.

That said, it feels like this case was doomed from the start, since they weren't attempting to charge him for his role as a producer, they were literally trying to charge him directly for the shooting, for being negligent. That was pretty much always a non-starter, no matter how you feel about the whole situation. The fact they then apparently withheld evidence is... Not good.

From the beginning, this was very clearly just an attempt by the prosecutors to get their names in the news by going after a big actor on trumped up charges.

This case was terrible from the start. No matter how you feel about what happened, he was never guilty, as an actor, directly. Actors are always the absolute last line of knowing if/when a gun may be loaded/malfunctioning/etc., there should be several people in front of them.

Charging him as a producer obviously had much, much more teeth, since it could be argued he had some say over how the set was run, who was hired, etc. and so on. This case in particular, though, just seemed vindictive from the start, and/or the prosecutor thought they could become a star.

Yeah, Brady violations are a quick route to getting convictions overturned on appeal, I'm surprised the prosecutors were stupid enough to do that.

What happened to victim was tragic, but the armorer is to blame. Unless it can be proven that Baldwin committed perjury when he said he didn't pull the trigger or if he acted negligently there isn't nothing to be done to him. Afaik he was following the directions of the director when the victim was shot. He has no way of knowing the ammunition is real.

I am no fan of Alec Baldwin at all. But I was a criminal defense attorney for six years, and I have said from the very beginning this prosecution is shady. I am not surprised by a Brady violation from this office in the least.

Im not following this case because I dont care, but I imagine the victims family is still going to file a lawsuit against him

I don't know the ins and outs of how to uncock certain guns or what would lead one to misfire like that.

The case would've had to lean on that since the judge tossed the producer argument.

And even then, your average actor or lay person would not have the ability to assess a gun's safety.

This was a stupid case and this should have ended with the armorer.

If you want to sue Baldwin into oblivion, go for it but he's not criminally responsible.

Because Trump and parts of the far right media (where Trump got the idea from) insisted that he's guilty. Also, yeah, he's a Hollywood Liberal and IIRC has criticized Trump (oh noes!) Keep in mind during said testing the gun misfired

So instead of acknowledging there may be something there they administered more rigorous "testing"

That's not a criminal matter it's a civil one, and the civil suit with the family was settled in 2022. This was a criminal case and in order to charge him as a criminal they had to claim he was directly at fault with the gun in his hands

The prosecution directed police to file evidence under a different case number and claimed it wasnt material. Then when caught the prosecutor called herself as a witness, that is fucking nuts.
