Can they? Interesting to think about. Its quite possible that they arent allowed to, since by definition theyre meant to be a constitutionally guaranteed service for those who cant afford it privately.

Then again public defenders are already bottom of the barrel service-wise (probably through no fault of their own in many cases) so even if they were required by law to act for this guy theyd just half-ass it.

In Australia they actually check your finances and refuse to provide you with an attorney or you are deemed able to afford one yourself. Is that the case elsewhere?

Also didnt this sort of thing come up recently when no lawyer would represent Trump? In that case did we find out if that scenario technically qualifies him for a public defender if the precious free market cuts him off?

A lot of attorneys who practice criminal defense choose a specific area of cases they won't take.

Only 20% of my cases are criminal. I do plenty of sex abuse cases, even ones against minoes. However, I won't take animal abuse cases.

"Win record" does not matter to criminal defense attorneys. It's not like a Call of Duty game where your stats are publicly visible. Nobody actually knows how many cases you "win" nor is it even possible to determine what's a "win" in criminal defense (outside of an outright dismissal/acquittal which is rare).

"Win record" can matter to prosecutors i.e. county attorneys, because the state does keep track of how many of their cases result in convictions.

Most of my cases result in plea deals. That means the defendant pled guilty, but I often view it as a "win" because, well, the Defendant was guilty, and now they have a much less severe sentence than they would otherwise.

To answer your first question, it's both. I personally love animals. I have two cats, I grew up with dogs, and nothing makes me more sad than an animal death or animal abuse. I just can't discuss things in good faith with a client that I know mutilated, tortured, or otherwise abused an innocent animal.

However, it's also because of how poor the results are likely to be. I know one of the county attorneys in my county will quite literally tell me to "pound sand" if I have animal abuse case because she does not negotiate when it comes to animal abuse. Many people are like me and despise animal abuse, so prosecutors are less willing to work with it.

Yes. I don't like to do it, but I can. It's my job, and someone has to do it. Everyone deserves their right to counsel in a criminal case.

Like I said, animals are a personal trigger to me. Other attorneys I know won't take sex abuse cases involving children. I definitely understand that. Perhaps if I knew a victim of child sex abuse IRL, I'd feel differently.

We're also not addressing the fact that some of my clients involved in sex abuse of minors are people I believe to actually be innocent. Others....well, I do view statutory rape differently.

For instance, I had this girl who was in her early 20s. She had a sexual relationship with someone who was 15. That was wrong. I knew she needed to take accountability and pay for what she did, but I don't view it quite the same as I would some 40-year old having a sexual relationship with an 8-year old. The victim certainly didn't view it the same either.

At the time of sentencing, he was 18, and he was horrified that she was getting into trouble (mandatory reporter case, separate from the other case I talked about in another topic). I got her a deferred judgment. She did no time in jail/prison, but she still had to pay for what she did. She's on the sex offender registry. She's not able to go to her own son's pre-school graduation because she can't step foot on a school property.

Yea, I'm able to do cases like that.

I dont think public defenders can refuse cases. For our justice system to work, defendants have to have lawyers, no matter what they are accused of, or how obvious their guilt may be.
