and also that wasn't a nintendo employee, that was a pirate... ... which IMHO shouldn't have been punished anyways, but dems the breaks

Dems is, but the strategy of giving him an exorbitant punishment for the sake of sending a message to anyone else that might consider following in his footsteps (the judge explicitly acknowledged that that was the reason for the sentence) is decidedly not fair at all.

I'd agree. It's a disproportionate response purely meant to send a message instead of being a suitable punishment for the crime, but it's at least a response to an actual crime being committed. A company-wide culture of being rapey douchebags is definitely worse.
