The constitution has never been a democratic document but an aristocratic one, and even after 300 years of compromised reforms, it has still arrived at a conclusion where an unelected court, appointed by a president that lost the popular vote, is determining the law of the land. All the while, a state with 40 million people has the same senate representation as a state with 0.6 million, and nothing gets done in a congress held by the majority party because the other side can just choose not to participate and thus shut everything down.

There is literally no path forward from this. Sorry to you boomers that were trying to compromise with authoritarians that think people should be imprisoned for being born gay your whole lives, but nothing has come of it. It's actually getting worse. Conservatives are the most open, hopeful and determined about how they think the country should operate as they've ever been since Jim crow era.

It worked somewhat decently for a long time. The advent of 24 hour news stations that control the narratives of everything the other side does is evil!! has thrown everything off the rails. According to the current ways of doing things, there can no longer be compromise that would be a weakness.

Where did I mention Roe vs Wade in the OP? This Supreme Court just invalidated New York's ability to manage gun violence with an atextual reading of the 2nd Amendment. New York now cannot protect its citizens from school shootings as effectively due to a lifetime court appointed by a president with a minority of voter share.

Not surprising that you'd try to turn the topic into an emotionally charged subject like RvW though, since it lets you ignore the absurdity of the Senate's distribution of voter power and its anti-majority rules that encourage the legislative body to delegate legislating to the unelected courts.

That's not to mention that the destruction of Roe v Wade opens the path for an R-senate to pass federal legislation banning abortion across the country, a desire of many Republicans, despite R seats tending to represent significantly fewer people.

From a game theory perspective, it's difficult for me to see how or why court-packing won't be the next answer. Before this round of decisions, adherence to precedent was enough to stay the hand of the Democrats while the GOP filled enough spots that align with their interests to get favorable decisions on new cases for the foreseeable future.

It is difficult to imagine a scenario where major legislation passed by any Democratic administration is not gutted by GOP-aligned judges. The argument of "well the court-packing may swing the other way" seems a lot less important when that is already the reality the Democrats face with the current makeup of the court for an indeterminate amount of time until they get lucky enough for two of the SCOTUS judges to die suddenly during a blue administration (unlike RBG, I'm going to guess they will step down during a conservative administration in order to maintain the favorable balance of power). In this scenario, what do they risk by court-packing?

Ultimately, our Constitution is insufficient to the needs of the 21st century, and was never intended to be the basis of an egalitarian, equitable, multiracial democracy. It was built to sustain a patriarchal, aristocratic, white supremacist colonial republic, and it is, unfortunately, quite good at that.
