If you were born as a different sex then you appear to be.
If you are married.
If you have an STD(if you know that is. Medical confidentiality should be waived in such a case, and a judge should be able to review the records to determine if something in there idicates that they, say, tested positive for HIV and then knowingly spread it. If so, they release only the pertinent portions of the medical records to be used during relevant litigation, then resealed.)
If you have a life altering or fatal genetic disease(same caveats as above)
I want to say criminal record, but the issue becomes do you only count felonies? Only crimes you were convicted of? Parking tickets? That one has too many moving parts.

I mean any life altering or fatal disease that could be passed on to a child. Think along the lines of knowing you're a carrier of the gene that causes Horrible Disease X, which has a 50% of making you all fucked up. If you have a child, there is a 50% chance of them getting this gene, and therefore there is a 25% chance that they come out with half a face or something. You should be required to inform a partner of this should you be aware of it.

Accidents happen, and they may not want to take the chance of potentially having a child with said illness.

Just like someone needs to make sure that their partner isn't inebriated, or has fully consented to all stages of an intimate event, both parties need to be fully informed on who they are having sex with.

Here's the thing. Trans people deserve to be who they want to be. But the person who doesn't want to have sex with a trans person? They deserve to be treated fairly too. If it's not about harm and instead about knowing everything, then quite simply, that list you provided isn't nearly long enough. You didn't include things like income, fertility, education, living situation, ethnicity, hobbies, if they own pets, if they engage in recreational drug use, history of ALL illness (physical and mental).

If you want something non-harmful to be included in informed consent for a first-time sexual partner, then that list gets VERY big VERY quick, and are you willing to commit to that yourself?

But the person who doesn't want to have sex with a trans person?

What about the person who doesn't want to have sex with a poor person? Or an Irish person? Or a dog owner? Or a gun owner? Should this proposed law of yours cover that too?

And it's not misleading. A trans woman is a woman. It's only misleading if she specifically says she's a cis woman. Otherwise you merely assumed and assumptions of that nature typically are not backed up in civil cases that would require someone make amends to you, as establishing the parameters of say a house sitting job would require actually putting things into words and not just assuming they'll do all these things you expect them to like bringing in the mail or whatever.

What rights is it infringing? Before reading my reply, I'd ask you to look in to the number of states that have rape by deception/ rape by fraud laws and how specific the circumstances must be to even charge someone with it. More than one of them requires other crimes to also have been committed to charge someone with it. For instance, statutory rape could also be accompanied with rape by deception if a 30 year old lady hung around a high school and said she was 16 and used a fake identity to have sex with teens. But in reality, very few DAs will ever even try and apply rape by deception because it's so incredibly hard to convict on or even to keep the charge on the table. There's plenty of other much easier charges to tack on to my example, such as criminal trespassing and child abuse.
