The fact that she relied on the product's label to tell her that the product was "mislabelled" means this isn't going anywhere. If she'd done some manner of independent lab testing to determine the amount of strawberry in it and found from that that there was less than the labelling suggested, sure, but all she did was read the package that she's claiming lied to her. The package told her the truth (at least as far as what she's complaining about).

If we want to go after Kellogg's for misleading labelling, maybe we should focus on the cereals that claim to have 18g of protein per bowl, but it turns out that relies on the protein content of the milk and not the cereal itself. Most things have 18g of protein if you add that much milk to them, including empty glasses.

labellings of food items for big companies are always gonna be off/incorrect/bullshit anyway. They pay good money to have other companies lie for them about what is on the label.

citation: worked briefly for a company that analyzed samples from companies batches of products to determine nutritional content. I was the fiber guy! what a title. Anyway, with big companies like Kraft, we could run their samples, get certain results, and if the data weren't within the specifications already established by the company, we would have to run the test again. Sometimes up to 10+ times. I gotta tell ya, redoing something over and over again till it fits the results you want doesn't sound like sound science or data analysis

ie: if the company analyzing the nutritional content of big companies doesn't match what they want to put on the label, they won't accept the results from the analysis until it fits what they want.

Mostly because I can just make a better poptart myself. It's just a basic pastry dough with jam inside. If I want that to be any good, it's very easy to simply make it. The only reason I'd buy poptarts is if I want something cheap and quick and don't care about the quality, so if they're made more expensive for the sake of improving the quality, that kills the only thing they had going for them. Plus, that's assuming they wouldn't just end up cutting even worse corners to make them seem better in this regard, which is most likely what would actually happen because Kellogg's is a terrible company (like pretty much every food megacorp).

That said, I honestly can't remember the last time I even ate a poptart, let alone bought some for my own kitchen, so I don't exactly have a horse in this race either way.

How about not buying the pop tarts period. This lawsuit is unnecessary.

She already bought them once, so she can get one refund. If she buys them again, shes on her own. So I stand by what I said
