A Former longtime Walmart Employee with Down Syndrome won a whopper 125 MILLION in a discrimination lawsuit against the retail giant who changed her work schedule and then FIRED her for chronic absenteeism!!

Marlo Spaeth was an employee at a Wisconsin Walmart for 16 years before she was fired in 2015 and in a lawsuit said she needed to maintain a rigid daily schedule as part of her condition that includes eating dinner at the same time every night

But they changed her hours in 2014 and made her work longer days that caused health issues of which she then filed a lawsuit by the US Equal Employment Opportunity Commission in 2017 on her behalf

When she asked to adjust her schedule by 60 to 90 minutes to get back to her noon to 4pm shift, they fired her and then refused to rehire her

An 8 member jury in Green Bay sided with her and awarded a massive 125 million in punitive damages and an additional 150K in compensatory damages

Although that number will likely be reduced to 300,000 which is the maximum cap on damages in ADA cases as a Walmart Spokesperson said it doesn't apply to back pay, front pay, litigation costs or interests

Randy Hargrove, a Walmart spokesman said the company doesn't tolerate discrimination and routinely accomodates thousands of employees each year

Punitive damages are the only way to hold hyper wealthy entities accountable in our current justice system, otherwise they can choose to just eat the legal cost whenever they calculate it'd be more profitable to break the law.

Some bullshit. I saw this happen way too many times too when I worked in retail. Asshole managers would change a person's schedule when they wanted them gone or put them somewhere they knew they hated to force them out

I was a store manager for a Sam's Club in 2010. My store made an average of 100k a day. I was fired for supposedly manipulating numbers. That's not true! I think they fired me because my employees were making about 5k in bonuse because of sales. I never once manipulated numbers.

Dont believe me if you dont want. Im not forcing anyone otherwise

Something like giving the victim a reasonable amount of money and then forcing the corporation to donate millions to some kind of related charity chosen by the victim would be a better way of punishing the corporation. With the exclusion of some very particular circumstances, nobody needs millions in restitution from a job, but the corporations do need to feel some kind of burn.

They fixed it to where she only gets $30,000. These mega corporations are so political that they literally cannot be sued for more than a pittance.

Theres a user here who was hurt in a car crash that his Uber/Lyft driver caused. He was only allowed to sue for $50k because big corporations have caps on what you can sue for. He only wound up getting like $5,000.

125 million is a slap on the wrist for Walmart. Should be 50 billion (or however much is like 25% of their worth). make them hurt.

she shouldnt get 50 billion, but give her equivalent to like 10 years wage.

and also send the HR rep, supervisor/boss and a higher up executive responsible to prison for 5 years.

This. I use to work at Walmart you can tell lot of people they hire and promote are only there to fill in some quota. Walmart's strategy is to get as many tax breaks as possible from them. When stuff like this happens they going to realize it's not worth it. Probably see them going to start abadoning diversity soon.
