He was convicted of a crime in the state where today is legal gay sex and a federal judge in Montana approved to have it removed from his record but the Montana state attorney general is appealing it claiming it weakens the state's sex offender registry law and opens up to additional challenges from out of state lawyers The legal age of consent was 16 in the state as Randall was 18 when he had sex with the boys but because having gay sex was a crime against nature, he was found guilty and spent 7 years in prison along with registering as a sex offender for life US District Judge, Dana Christensen said the state of Montana has no valid reason to require him to remain on the sex offender registry and cited a 2003 US Supreme Court ruling that laws criminalizing consensual sodomy or oral sex were unconstitutional It said "None of the governmental interests in maintaining a sexual offender registry are served by Menges inclusion. Engagement in intimate sexual contact with a person of the same sex, without more, cannot be said to render someone a threat to public safety" Menges said after the ruling "I guess i'm just grateful, honestly, that the judge actually listened and was fair because for the last few years of my life, i don't feel like anything's been fair" The order is to have him removed from the registry before or on May 21 and expunge any records indicating he was ever subject to registration and alert all agencies that may have provided in Elizabeth Ehret, his lawyer tweeted on the win who said Gay Montanans can't be forced to register as sex offenders for consensual gay sex...and while they've won now, they still have a fight on their hands as the state will appeal the verdict to protect the state's sex offender laws from lawyers who are "more interested in politics than the safety of Montana children" He moved to Montana in 2018 hoping to start a new life but a 2005 state law says anyone on a register in another state must register as a sex offender if they move to Montana.. Matt Strugar, a lawyer challenged a similar law in Mississippi said there are likely hundreds of people like Menges who are being forced to register as sex offenders which is a violation of their right to due process and equal protection under the 14th amendment He said "I'm outraged that in 2021 that we have what is essentially a registry of gay sex. Plus if somebody has been on an offender list for over 20 years without re-offending, they should have the chance to be taken off it anyway.
