I was looking up info for a friend, and found out that lifetime limits was removed with the affordable care act in September of 2010.

My wife became very ill in March of 2011, was in ICU for 3 weeks, and then in the normal hospital room for another 3 weeks or so, our insurance (through work), forced us to move to a hospital 2 hours away that was horrible, and then dropped us not much later saying we reached the 1 million lifetime maximum.

At the time I was way to busy helping my wife (in fact my mother passed during all this and I was unable to go to the funeral or even keep the mobile home I had gotten for her) to check into HOW we got to 1 million so fast (surgeries I guess, plus ICU was expensive. I certainly didn't know about the care act and that they could not cancel for lifetime coverage anymore.

I have done some research and it sounds like they could put off making the change, until your current policy ended, so if hers renewed after april 2010 but before september 2010....they might still have been able to cancel it legally. I don't know if it's possible for them to have canceled it even if they shouldn't have been able to, and just hoped Linda would die, or nobody would notice (she was not expected to live at all).

There were tons of other things that were horrid about our medical system over the next 6 years until she passed in Feb of 2017, and I have tried to just put it behind me. I didn't want to sue them etc, I just figure that would increase cost for others if I did. I just found out about this last night though and even if what they did was legal, it was literally not going to be legal in a few months at most anymore. Honestly the worst thing the insurance did was make her go to that other hospital in the first place (she had a small wound in her thigh from necrotizing facitis at Saint Luis, and was already standing, but when they did surgery to close the wound they caused a massive one all the way across her belly to her back (she was almost cut in two) that took almost 2 years to close). We couldn't find anywhere to take care of her with a wound that large so I did it for 3 years (2 packing the wound, changing a colostimy bag, changing a cathedar every 3 days etc).

I don't ever know if I should look into this or just try and focus on moving forward, but if anyone knows specific info on insurance at that time, I'd love to chat with you (PM me if you could). Thanks.

Call the guy from Pawn Stars. He probably has a friend who's an expert on health insurance from 2010-2011.

So I guess the questions is, what would you be suing for exactly? That's the first step in whether or not you should be suing.

That's why you call a lawyer to discuss it.

Honestly I don't think I want to sue, but I would like closure and to know if what they did was legal. Honestly wish I hadn't found out about it.

Money doesn't really interest me past the point of being able to live without taking away from other people etc. I don't buy things for myself, and I'm not gonna get in another relationship, so whats the point. It's not worth the stress fighting them even if they were in the wrong.

Main thing is it just made me feel horrid when I saw that last night, maybe i'll get over it. Still if someone knew what the sitch was back then, it would be nice. I'm guessing they dropped us because it was their last chance to do so, and they didn't actually do anything illegal. Just makes me feel even worse about our medical system in this country.

Your questions aren't going to be answered on a half dead message board. You're going to need to talk to a lawyer, who will probably want a retainer to even start the discussion.

Shrug you never know, someone might have worked in insurance or something, but yeah prob not. I'm certainly not gonna persu it right now. Was just a shock last night when I saw that and then did the math on the time etc. The whole situation was screwed up, I already knew that, but things like that can drive it home again sadly.

Getting a consultation with a lawyer who specializes in this stuff is the best way to go about it, they will let ya know what options are available. Asking a message board for serious advice of any sort of nature is really dumb, some will even act like experts on it when they aren't.
