The woman who sued wasn't even looking to make money, she was only wanting her medical expenses for severe burns caused when the massively overheated cup spilled while they were parked. McDonald's had tons of warnings about this prior, and had indeed severely burned other people, and decided that rather than fight it, it was cheaper to settle and spend money defaming the woman and making the lawsuit look frivolous.

I still find it hilarious that when people argue against cases like this they cite personal responsibility and cite the old lady as responsible for her injuries, but ignore that McDonalds failed to adhere to a pretty major health code by serving the coffee at such a scalding hot temperature.

The car was parked. She was a passenger in the car.

If McDonald's had kept the coffee at a safe temperate, she wouldn't have need skin grafts. That's the issue.

She only wanted enough money to cover the medical costs and stuff. It was less than 20,000. McDonald's kept coming back with low-ball offers and then launched a smear campaign against the woman.

They had gotten in trouble multiple times before the incident for keeping their coffee above the standard safe temperature just FYI. So this wasn't even the first time. This was just the first time someone was horrible injured as a result.

A hammer is not an unsafe product. It exists generally at room temperature and if I stick it in my crotch it stays where it is and doesn't burn me.

You can't sell things that are at unsafe temperatures. If I heated up the hammer to 400 degrees first, it would be extremely irresponsible to sell it, and sticking a "caution: hot" label on it doesn't absolve me of my responsibility to not sell dangerous products.

Selling 200 degree coffee is like selling someone a bottle of elemental fluorine and saying "caution: don't open this"

It shouldn't. It should be safe to use. And if you use it and the head flies off the handle and breaks your nose then guess what, you're entitled to sue the manufacturer. Thousands of people spill coffee on themselves daily. Almost none of them go to the hospital to get surgery as a result.

What you do in your own home with your own pots and pans is your own business. When you're operating a public establishment handing out coffee, that coffee needs to be under a certain temperature which it was not and McDonald's was regularly in trouble for violating that regulation before the incident.
