It exists generally at room temperature and if I stick it in my crotch it stays where it is and doesn't burn me. You can't sell things that are at unsafe temperatures. If I heated up the hammer to 400 degrees first, it would be extremely irresponsible to sell it, and sticking a "caution: hot" label on it doesn't absolve me of my responsibility to not sell dangerous products.
