Right now a pastor in Baltimore is trying to keep his church open, even though the state has issued all non essentials closed down and a stay at home order, since he says the law can't shut down any religious gatherings. Do you think he should be allowed to keep his church open even with the stay at home rules in place and rules to limit the gathering numbers?

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

It is illegal to prevent the people from not being able to assemble. I know noone wants to have that conversation because COVID-19, but I mean, there it is, plain as day, 1st amendment.

It will be interesting to see how this plays out in courts. It's best to have your own church at home. I can understand wanting to keep a church open to help the community, but you can worship at home.

and yet, peaceful protests get broken up all the time...

you're ignoring the fact that the supreme court has ruled, time and again, that it is not an absolute right. that the federal/state/local government has the right to limit gatherings as long as its done neutrally, with no bias towards a specific group of people.

Current jurisprudence is that the rights conferred by the Bill of Rights are not absolute, but rather that restrictions placed upon are reviewed with varying levels of scrutiny based upon the state action in question, the justification for the state action in question, and the costs associated with said action in terms of abridging aforementioned rights.

This is most notorious with the "shall not be infringed D:<" crowd, who have likely never looked into any actual law on the matter.
