We had someone do that about 10 years ago - parked in our driveway and went down the street to a school Christmas concert. We called the cops, and the officer said we could tow it at our cost. We told the officer we would move it on the road and the officer said to call when we did so he could have it towed for us at the owner's expense. We never did move it - we caught the owners and told them to move it or it would get towed - they moved it right away.

I know somebody who lives in Canton, OH Every annual Pro Football HoF induction weekend they get out-of-towners parking on side streets, resident's lawns, driveways, backyards, etc and walking to the venue. Imagine that happenig to you.

Unfortunately you need to take action. Eventually she can claim the driveway as her own. Look up adverse possession, and also the statutory limit of it in your state. If she continues it for that long, say 10 years, legally it becomes her driveway.

Call the police. Have it towed. Trap her in. Those are your options.

Doing nothing is just encouraging her to keep doing it. She currently has no consequences.

Reminds me of the time church nearby started their own busing service for people with no vehicles. They stopped by to advertise for reliable transportation... Then got stuck in my yard. I told them not to back into the yard to turn around, but they did anyway. This is the aftermath of about an hour of them trying.

You're right, I did not. I do not want to escalate this, especially because the house will be on the market starting tomorrow. The neighbors have not parked on my driveway again since they removed it earlier this week, so that's a plus.

It absolutely does. The wife is unemployed and stays home all day. She could absolutely fuck me over when there are potential homebuyers visiting, and can even fuck me over by doing stupid shit (like break my windows, have strong odors, don't take care of their house, etc.).

And if the neighbor retaliates and does this crap, sure I have video evidence, but ultimately, it'll cost me months of litigation and extra cost while the house is still on the market.

She has stopped (for this week so far).

I have spoken to my realtor on this matter (who is also a lawyer) for future reference, and she did tell me that cops cannot tow the car because it is on private property (I have to get a tow company to tow it), I cannot block her car in my own driveway (the cops can actually tow my car if I do because my car will be on the public road), and obviously advised not to do anything destructive.

In my state, all you have to have on your property is 2 no trespassing signs, and you are legally allowed to consider your property private. What that means is, if you post a couple signs, they dont have to be big, then she is trespassing if she does it again and you have legal standing. I dont know about your state.

There was no damage. The grass sprung back up. Perhaps you don't know this, but unless you peel out on grass, there is no long lasting effect on driving over grass. What they did was not destructive, but rather very trashy.

In addition, you might not know this, but calling the police to report such actions doesn't mean anything. Pressing charges means you have to now go provide evidence, talk to prosecutors, convince them to continue to actually press charges (which for simple shit like this, they won't), and if they actually do, or I pursue this via civil court, you will go to court. I entirely get where you are coming from, I legitimately do. I used to be that guy. I learned my lesson, and at this point as a homeowner for near 15 years, you need backbone in these situations.

I think given the circumstances, of trying to keep the best relation possible due to the house on the market, I consider this a win. Now if she comes back and parks, I am definitely calling the police and a tow truck. I already researched tow truck companies, because I fully expected her to continue this past week.

Trespassing is a criminal offense if she knew she wasn't supposed to be there (check) and a warning or notice was provided (check). However, criminal trespass is usually combined with another criminal act (like theft, breaking and entering, etc.). If it's just to park a car, prosecutors will rarely pursue the case, so it'll just end up being in civil court.
