Your team loses, you grab a cushion off the couch, and throw it across the room in a burst of anger because you just lost a bet. Upon doing this, it hits another roommate in the head who just came into the room, bounces off, and knocks a lamp over.

At this point, could that second roommate call the police to say you assaulted him? There is proof (the lamp that was knocked over) and a witness (the first roommate sitting on the couch with you), even though no physical harm came to him.

Technically....yes.

And HOPEFULLY the cops would fucking laugh in your face.

Sadly, depending on the gender of the victim, and how good of an act they can put on.....you could seriously get someone arrested under the right circumstances.

When cops show up to the scene of ANY domestic dispute, any kind of "assault" claim, etc......someone is getting arrested. Even if it's total bullshit and can all be worked out down at the station.....someone is going to jail. Whether an assault "conviction" comes out of it or not....is another story.

The cops can arrest you simply under suspicion that there was more than meets the eye. If one person is saying you assaulted them, and they have a rash on their arm....they can say that's where the pillow brushed against their flesh and "hurt" them.

Cops can justifiably arrest you then.

And if you throw a fit because you are being arrested for something so fucking ridiculous and petty.....be warned: Even VERBALLY resisting the cop's arrest, can result in a "resiting arrest" charge....which will look even worse than the "assault" for the pillow.

Andif you so much as wriggle in the cop's grip and your elbow accidentally makes contact with the officer's ribs or any part of his body....guess what? You just assaulted an officer.

I am not even kidding. None of this shit is an exaggeration. This is shit that can actually happen to you. And shit like this DOES happen on a daily basis.

As I picture it the roommate is a petty jerk and basically throws technicalities around until he gets his way and is able to press charges.

The police would try to talk him out of it but he would put his foot down and insist that an arrest be carried out.

In this really hypothetical situation he could claim he was assaulted but it wouldn't stand as he simply walked into the wrong place at the wrong time, said assault wasn't pre planned but more importantly the other roommate would be able to say it was a accident as he would be the only whitness. The only proof the cops would have is a lamp knocked over.

You mean battery, not assault, but in either case I'm pretty sure a legit charge would need to prove intent in some way so worst case you could be stuck with some sort of harmful negligence charge.
