That's because he was informed for a 10% to 15% chance of tropical force winds could impact Alabama, based on models he had received on the day that he did that. NOAA disavowed what the NWS said about what the President did.

He said he was informed it was a 95% chance

So... rather than waiting for the NWS to make an actual statement to that effect (which would presumably include actual probabilities and other useful information), he took a sharpie to an existing map so he could prove he wasn't wrong? You're not exactly doing your lord and cheeto any favours there, dude.

This is pretty inconsequential either way. Nobody experiencing these kind of events are watching CNN press conferences to track a storm. You're watching your local weather or weather channel or monitoring their web site.

So a government agency has debunked a #fakenews story and you're not going to trust it because it contradicts the fake news? idk, sounds like you're the one attacking the facts with a sharpie now! And honestly, what's the claim here? That the president just decided to randomly do something of his own volition with no apparent motive? That's your alternative to him getting bad information from another agency?

You know, Trump being unable to understand something as simple as a weather forecast is bad. Him refusing to let it go and taking a sharpie to a map to try and fix it is worse. But the worst part about this whole stupid "scandal" are the parade of unrelated adults scrambling to cover for Trump and defend him and insist that this wasn't wrong and a really stupid thing to say to boot.

Like, seriously, the guy was wrong. Just own up to it and we can all move on with our lives. At this point, you are literally arguing that the weather is wrong because Trump said so.

wait why is this a felony?

Whoever knowingly issues or publishes any counterfeit weather forecast or warning of weather conditions falsely representing such forecast or warning to have been issued or published by the Weather Bureau, United States Signal Service, or other branch of the Government service, shall be fined under this title or imprisoned not more than ninety days, or both.

Based on that, Id say he didnt break any laws. Hes just going up there showing off purty pictures. Hell, he didnt know category 5 hurricanes were a thing.

Theyve got to prove that he did it and prove intent. I mean if it went to trial theres a possibility he could lose.

Ignorance of the law is never an excuse. He intentionally committed an action that is a crime. Whether or not he knew that said action was criminal doesn't change that.

Proving intent is important for the prosecution. And Im saying this from experience. If he knew it was wrong, it makes it worse for him.

It's pretty hard to accidentally mark up a map with a sharpie and then present it as evidence for a point you're trying to make. The act was very clearly intentional. Ignorance of the law may be a mitigating factor in sentencing, but it does not change that a criminal act was committed.

Of course, it's not like he'll ever actually face these charges in court, because that's just not how these things seem to work, so how easily he could prosecuted is sadly a moot point.

No, this is general court procedure. There was a mistake with my drivers license. When I first lost my current provincial one, I was under the impression that only that license was gone, so I went back to Alberta to get my license, they (actually) gave it to me, which didnt help disprove my belief, and then I got stopped after I had been back in my current province and the cop explained it was Canada-wide. So I hired a lawyer and he explained that they will need to prove three things. Two of which were that I was driving the vehicle, and that I was doing it knowing I wasnt supposed to be.

It can - depends on the specifics of the crime and the jurisdiction. In some cases, ignorance of the law *is* a defence. You have to prove that a person was knowingly and willingly doing something they knew to be wrong. If someone violates the law but was not aware of it and made no attempts to hide it, they lack criminal intent - for some violations, that is sufficient to avoid prosecution.

For instance, if a drug dealer's home is being raided by the police and the dealer starts flushing all the drugs he has down the toilet, he is guilty of obstruction of justice. He is intentionally disposing of incriminating material in an attempt to conceal a crime. On the other hand, if his mother came across some of his drugs, assumed they were expired medication, and flushed them down the toilet as a means of safely getting rid of them, she would not be guilty of a crime in most cases. Even though she is conducting the exact same activity, she lacks criminal intent. Due to a lack of information, she did not realize that she was committing a crime.

https://en.wikipedia.org/wiki/Intention_(criminal_law)

Now, admittedly, that example isn't ignorance of the law, just ignorance of the specifics of the situation. But it can apply to the law too - I'm familiar with examples in contract law and tax law, where if you can show that you made a good faith attempt to follow the law and your ignorance of specific requirements of the law led to a violation, it is typically sufficient to avoid prosecution, and any prosecutor who opts for charges must prove that you knew that what you were doing was a violation of the law.

I'm not a lawyer and I have no idea if it would apply in this specific case, but the old phrase "ignorance is no defence" isn't 100% true.

A strange coincidence. But a legitimate one. Usually my first edits are (edit) correcting mistakes, and every subsequent one is to avoid double-posting. Which on most other forums Ive used is against the rules. If youre insinuating that we are one and the same, then the way we talk should give away that we arent the same person.
