17 y/o Anthony Temple, a boy who was thought to be missing by his family in Texas 11 years ago and kidnapped by his father is now charged with the MURDER of his Father!!

He was taken from his Houston home by his "violent" dad, Burt when he was 5 and his family said they last saw him with Burt Temple in 2008

Anthony is now being held at a juvenile facililty in Louisiana after he shot his dad 3 times during an argument. The teen said his dad got drunk and started a fight with him.

He grabbed 2 handguns in case one failed and fired and shot his dad. He then called 911 as police said Burt had gunshot wounds to his head and torso where he died a few days later

His sister, Natasha said she and her family have been waiting to hear if the teen was alive who said "He has been secluded and abused all these years by his own father. My brave brother had to defend himself for the last time against that evil man"

Burt was charged with assault 3 times between 2001 and 2002 but both were dismissed

His ex wife filed for a protective order just months before they saw Anthony for the last time.

Natasha said "Burt and my mom were together for about 10 years and it was extremely violent. I can only imagine what Anthony's been through. When he was a baby, Burt would hold him in his arms while abusing my mother"

She also filed for a protective order against him when he knocked out her TEETH!!

They posted missing flyers around Houston after he was taken as both posters have him and Burt on it

The DA will be reviewing information from relativevs before deciding what actions to take

For now, Anthony is held on manslaughter charge but it's possible for a grand jury to up the charge to murder or decide if it was self defense and let him go

Given the circumstances he had been placed in, I'd think most juries would be sympathetic and refuse to find the kid guilty for any serious charges.

But, this is Texas...

Murder is murder. The bastard deserves to be locked up. Nobody should get away with murder, and retaliation for the kidnapping is not a valid argument. However, he will probably get acquitted anyway because America and "B-b-BuT mUh SeLf DeFeNcE aNd GuN rIgHtS!!!1!1!!".

it does sound like self defense to me. murder is murder. but this wasn't murder

There are plenty of ways to defend yourself without shooting someone in the head and killing them.

Probably wasn't thinking clearly due to all the abuse. Also possible he grabbed a gun and shot to stop his dad from abusing him more.

It's extremely circumstantial, in fact English Law allows a pre-emptive strike as long as the attack is reasonable to stop an imminent attack and the person believes they can't escape without being attacked.

Have you ever been abused? If you haven't, you're passing judgment from a place where you have absolutely NO Idea what trauma does to you, or what it's like to live in constant fear for your safety.

There's a very important difference between killing his dad to retaliate for being kidnapped and killing his kidnapper to escape. The former would indeed be murder, albeit the circumstances here (namely the prolonged abuse and what that does to its victim's mind) would be a very strong mitigating factor in sentencing him. The latter is thoroughly justifiable self-defence.

I've never beaten a child to death but I can tell you those who do are scum bags to say the least.
