A Hennepin County judge has struck down an ordinance in Dayton, Minn. that restricts where sex offenders can live in the community, saying the measure is trumped by state law. The far-reaching ordinance barred convicted sex offenders from living within 2,000 feet of any school, day care provider, park, playground or public bus stop even a pumpkin patch or apple orchard within the city of Dayton, a rural community of about 5,000 residents northwest of the Twin Cities. The measure was hastily passed by the Dayton City Council in late 2016, after local residents raised alarm over plans by the state to move three convicted rapists from the state sex offender program to a group home in the city.

In a recent decision, Hennepin County District Judge Susan Robiner declared the Dayton ordinance void and invalid because it was expressly designed to conflict with a state law that establishes a legal process for releasing civilly committed sex offenders from the Minnesota Sex Offender Program (MSOP) and reintegrating them back into society. Such local ordinances, the judge added, would have a devastating effect on the MSOPs ability to discharge offenders from the program.


Looks like the another part of the sex offender registry is ruled unconstitutional. Wonder if the whole thing will be gone in a couple years.

I think what we're more likely to see is more tiers of this stuff. Sort of like how we have different levels of murder with different punishments. The problem is you really want to keep actual violent sex offenders away from potential victims, but in some places being drunk and peeing in a park at 2AM can get you put on the same list.

all for tiers. being a 20 yo who sleeps with a 17 yo shouldn't put you on the same level as a guy who raped little kids.

Good. Effectively ending the lives of all offenders regardless of why they're on the list is cruel and inhumane. When they can figure out a system for weeding out people who, say, peed behind a church compared to a child molester then they can have their scorched earth policies. But until then I'm fine with this judges opinion.

Good.

Its asinine to release a sex offender yet make it effectively impossible to participate in society, have a job, have a house etc.

Either you execute them/life without parole or try to rehabilitate them. Some half asked "fuck em. Toss em on the streets" approach is cruel and dangerous.

How TF can you find a house that is not within 2000 feet of a park, bus stop, pumpkin patch/Orchard, apartment building, day care, school etc. unless you live on a farm or something.

Plus the law sounds like it affects say someone who whipped his dick out drunk at some wild college party as much as someone who actually raped a kid.

Allegedly some dude got caught doing it by a kid. Mom freaked out and said he was flashing her son when she found out about it and dude got hit with hammer in court. That being said, it's not standard for this outcome to happen at all.

all crimes should be tiered imo. It's hard to get a job after going to court for anything. It's almost set up for you to fail. Why should someone involved in a street fight be turned down from job offers? A lot of people get in fights, just a matter of if you get arrested for it or not. But in the eyes of the system, you are just as screwed in life as a murderer unless you get it expunged
