I dont get it. Why is sex the one time where a drunk person cant legally control themselves? Drive drunk? Your fault. Assault someone while drunk? Your fault. Kill someone while drunk? Your fault. etc. IDK if Im just crazy but it doesnt make sense to me.

I have a very high tolerance and willpower, but even I've gotten drunk to the point I forgot events from the previous night or ended up back home and not know how I got there. That's the kind of drunk TC seems to not think exists lol.

Im aware, but if you get to that level and do literally anything but consent to have sex, youre still considered responsible. Its not like if you get arrested for drunk driving you can just say but officer I was too drunk so I couldnt stop myself.

So you normally wouldnt have made that decision to consent, but since you were so fucked up someone used that against you to fuck you, so theyre at fault for taking advantage of you in that situation.

Obviously drunk sex happens all the time though. Slippery slope I guess. Probably more seen in what youre talking about when one party was sober and the other wasnt

Im going to be honest, Ive never blacked out before. Closest Ive came was getting completely and utterly couchlocked when crossfaded once, to the point where I couldnt even move my arms or speak. But I could still see and hear and stuff. So I guess I just dont have that experience.

Add the fact, that gauging if both parties both truly were drunk and to what degree would be legally rather difficult

So it's better to criminalise drunk sex and then try to work out the exceptions, rather than the other way around

The problem isnt that "drunk people cant consent"
Its "drunk women cant consent" being the law in practice that causes issues. A man can be drunk, and still be liable even if the woman is sober or drunk. The woman is always the victim in the eyes of the law, its incredibly biased in their favour. If both sexes were protected equally, this wouldnt be an issue, but only women are protected.

Although really, you should still be responsible for your actions while drunk. Its not like drunk drivers are protected.

Yes, it is. A person can plan ahead to avoid drunk driving. There are hundreds of alternatives that you can plan for, especially since you *probably* know you're going to get drunk ahead of time. It's a part of responsible drinking.

That is entirely different than a person being taken advantage of in an inebriated state.
