mrduckbear 11/21/18 12:52:48 AM #1:	Was this the right verdict? - Results (1 vote) Yes 100% (1 vote) 1 No 0% (0 votes) 0 Oregon Prosecutors will NOT prosecute a Black Fedex Driver who TKO'd a Racist White Man who shouted the N-Word at him in Portland back in September!! They said there was no indication that Timothy Warren intended to kill Joseph Magnuson during a September 26th brawl near Northeast Hoyt Street and Northeast 29th Avenue. Magnuson, who witnesses said INITIATED the confrontation by hurling the N-word at him as well as other aggressive and abusive phrases as he egged him to fight him and even made hand gestures while hurling racist words to get him to engage. The medical examiner said Joseph was in "extremely poor health" which is why he died after taking a fatal punch. Witnesses said Warren was driving his truck slowly into the neighborhood to drop off packages when Magnuson sees him and yelled "very aggressively" at him for him to slow down. Warren then stopped and tried to speak to him but James kept escalating hostilities and said "Come and hit me" while yelling the n-word over and over again. Both men then started a screaming match and suddenly Joseph THROWS a DRINK and BAG OF FOOD at him. Timothy then punches the second bag of food out of his hand and Joseph throws a punch at him but it doesn't connect, at which point Timothy then fatally punches him with one blow. He remained at the scene while speaking to police as he cooperated with police.. D.A Adam Gibbs said though Joseph would sitll be alive if he ignored him, "the decision by Mr. Warren, who is black, to not let the racist vitriol to which he was being subjected to go unanswered is not of legal significance. Oregon law contains no duty to retreat and Mr Warren was within his right to exit his vehicle and verbally challenge the manner in which Mr. Manguson was addressing him. It can, but you're in a lot murkier waters there, and it has to be threats where you actually fear for your safety, not just, "Go away, [racial slur]!" People tell me to slow down all the time. I usually just drive faster or spin my wheels.
