It's trying to use EOs to ignore the proper way of amending the constitution. EOs are bad because they literally reverse the way the government is supposed to be working. Judicial should absolutely not be the one to say "ERRRR wrong, you're not doing that Mr. President." That's literally supposed to be the legislative branch that's being told not to do these things.
