17 y/o Michael Wishon, a BLIND high school student from North Carolina was cruelly bullied by a group of boys where they STOLE his IPHONE that he got for his BIRTHDAY and then STOMPED IT before giving it back to him!!

Police have now launched a criminal investigation after the video was uploaded to facebook by Donnie Morton, who is Michael's Uncle said that Michael got that phone for his BIRTHDAY which was the SAME DAY the bullies took it and smashed it.

He was in Masonry class at South Stokes High School when a boy snatched the IPHONE 5 out of his bag and stomped it and smashed it with a brick and used that damaged phone to video tape himself taunting Michael.

Michael is legally blind in one eye and has other disabilities while the rest of the classmates LAUGHED and did nothing but watched as that video was shared all over snapchat

The shaky footage showed the teacher BLAMING MICHAEL who kept his phone in his bag instead of having it out in the open and stated it wouldn't have been stolen and broken!!

At the end, the boy recording approaches Michael and MOCKS him asking him "you have a comment on the 2018 phone breaking?"

Michael walks away teary eyed and the boy says "i'm sorry for your loss"

Donnie said the teen who smashed his phone was just SUSPENDED for ONE DAY after the principal concluded "it was just horse play, not a malicious act"

The video was viewed more than 93,000 times as the Principal said they disciplined it based on the school's handbook and nothing more needed ot be done.

The video went viral and now an investigation was opened and the principal now says further discipline will be involved referring to the sheriff's office.

Criminal charges may be filed but said state and federal privacy laws were preventing them from disclosing the names of the bullies or revealing the punishment.

Kelly Wishon, Michael's mother said it made her question her son's past treatment in the past who said "He's always coming home with chewed bubble gum stuck to him"

Dozens of members of Bikers against Bullies USA escorted Michael to school and staged a silent protest to raise awareness of bullying.

A Gofundme was launched to help Michael get a new phone and to spend for a new birthday celebration for him and it's also stated that his father is TERMINALLY ILL as well...

horseplay?!?! Picking on the blind kid who can't fight back isn't horseplay. Schools are actually useless when it comes to bullies. People wonder why so many kids get fucked up early on.

I can't believe the teacher blamed him. And most schools want the students to keep their phones in their bags. He needs a new school with a better principal, better teachers, and better students. I'm shocked nobody helped. I know people end up under the bystander effect, but still... People just suck sometimes...

wtf.... Granted, it's more a matter for the cops and courts than the school, but that clearly sounds malicious and something that warrants a longer suspension.

Yeah, that's fucked up. I pick on people all the time and am in general kind of an asshole, but anyone that bullies someone with a disability can die for all I care. I will always intervene in situations like that.

Some google seraching tells me that:

1) iPhone 5 is a 6 year old model that sells for between $100-200.
- and -
2) Malicious destruction of property valued under $250 is a misdemeanor punishable by 1 year in jail and restitution of 3 times the value of the item.

1 day suspension seems more like a reward. It may be all the school was capable of doing in response but is not the extent of punishment that is warranted.

That's really for a court judge to decide and, fortunately, there's video of the crime being committed on which to base that decision.

Yeah, this should be a pretty straightforward court case. The one-day suspension is pretty laughable, but the kid will get what's coming to him. It's really not a good idea to break people's expensive stuff and record yourself doing it.
