The specifics of that law are that both parties are to give positive consent, which can be revoked at any stage in the encounter. A person otherwise intoxicated or incapacitated cannot legally give consent.

If sex is happening and the cis-man revokes consent because he learned his partner is transgender, and the partner continues nonetheless, that's sexual assault. That's the only way this case would be sexual assault.

What I'm talking about is a hypothetical situation. Cis guy asks trans women is she's trans, she lies and says no. He gets a BJ then right after she whips it out and says "tricked ya lol". He precedes to punch her in the face. He shouldn't have punched her but she gets no sympathy because she kind of asked for it.
