"The Florida man who claimed his girlfriend choked to death during oral sex was found not guilty of second-degree murder Monday.

Richard Patterson, 65, of Margate, was acquitted of killing 60-year-old girlfriend Francisca Marquinez in 2015 after a week-long trial, according to the Sun Sentinel.

During the trial, his lawyers initially argued that Marquinez died accidentally while performing oral sex on him at her apartment.

To bolster their defense, Pattersons lawyers filed a motion to show his penis to the jury.

But after a medical expert testified that choking during the sex act was unlikely, the defense reversed course on the theory. The judge never ruled on the request to put Pattersons member on display in court.

Thats not the way she died, defense lawyer Ken Padowitz said. But thats the way Richard Patterson thought she died.

Instead, the defense argued that there was no way of knowing how she died. Medical examiners never determined the cause of death because Marquinezs body was too decomposed.

They still dont know how she died, said Padowitz, according to the Sun Sentinel.

The jury spent five hours deliberating before reaching a verdict.

If Patterson had been convicted, he would have faced life in prison."

This man was found not guilty due to a complete lack of evidence.

There was no signs of a struggle, no marks on the body consistent with assault or stranglation and it's not even clear how she died period. it's just clear that there was no aggression and there is also no motive, its also clear that the couple had consensual sex shortly before she died.

He did not get off because of the "big penis defense" which was disregarded and ignored. He got off on innocent until proven guilty because there is close to literally nothing implicating that he did anything at all to her.

Articles like this are just trying to clickbait you into thinking his penis adventures are relevant to how he got off to make a story where there is none.

It's like saying "Murder suspect Dr. Richard Kimble's jumping off a dam defense finds him not guilty!" no the fact he didn't do it found him not guilty, him jumping off a dam was something stupid he did along the way.
