They're REALLY reaching with second degree murder. No chance he gets convicted. I assume the government is hoping he gets murdered in prison and it never gets that far or something.

yeah...unless theyve got some damning evidence that no one has foreseen then i cant possibly see a conviction on the murder charge

to attempt to defend your obviously racist statements?

as a non-racist, I believe that black people are capable of correctly judging the facts of a case, even if other black people are involved

im with you here but there is a lot of research that discusses the impact of the racial makeup and jury on case outcomes. id have to go back to the literature but for black defendants i think it was that diverse juries are the most lenient, primarily black ones are more lenient than average to a black defendant, and primarily white juries depend on the jurisdiction (a mostly white one in alabama is more likely to convict a black defendant than say a jury in maine).

It only takes one reasonable black person to force a mistrial. I mean, I would agree that race may play a factor in these decisions for many people but the idea that if you took twelve random black people that all of them would base their decision entirely on racial bias strikes me as pretty racist.

for the OJ case the key that many experts point to isnt the black majority on the jury, it was the black women majority that mattered since they hated the whole white woman marrying a rich black guy thing

You could make the argument that an all white jury would side against Zimmerman.

White guilt and all that.

You could, I guess, but numbers show that there's a fairly clear trend of racial empathy involved. There's a reason jury selectors take race into account. Unless SMuffin thinks he knows better than the experts!

I'm sure it's a factor, but like I said, I think it's idiotic to assume that an all-black jury means a guaranteed conviction.

you cant strike anyone on the basis of race, although you technically could do it under the guise of a peremptory strike

Yeah, this is old, but I may as well say it.

I think the prosecutor is gambling. She'll get a manslaughter charge one way or the other, but she's trying to intimidate Zimmerman with the possibility of life in prison. If this works, then she'll cut a deal with him that involves a guilty plea to manslaughter. It avoids a trial, and quells the public outrage.
