It's not even possible to effectively enforce this kind of thing, is it?

That article's pretty bad and doesn't really say... anything... about what the law would actually do, but going to Kotaku's article reveals this:

"It is unlawful for any person, with intent to terrify, intimidate, threaten, harass, annoy or offend, to use a ANY ELECTRONIC OR DIGITAL DEVICE and use any obscene, lewd or profane language or suggest any lewd or lascivious act, or threaten to inflict physical harm to the person or property of any person."

Which isn't nearly as bad as "Arizona bans all trolling!!!" I mean, I don't think you'd have much luck arguing it should be illegal to annoy or offend people. On the other hand, terrifying, intimidating, or threatening someone is probably a thing that should be illegal regardless of whether you do it over the phone, over the internet, or in person.

I also have to imagine that 99% of the cases they're envisioning involve two people who know each other in real life, and not SSJGokuroth trolling some Pokemon forum.

It's still pretty dumb and worded way too vaguely though.

A. It is unlawful for any person, with intent to terrify, intimidate, threaten, harass, annoy or offend, to use any electronic or digital device and use any obscene, lewd or profane language or suggest any lewd or lascivious act, or threaten to inflict physical harm to the person or property of any person. It is also unlawful to otherwise disturb by repeated anonymous electronic or digital communications the peace, quiet or right of privacy of any person at the place where the communications were received.

B. Any offense committed by use of an electronic or digital device as set forth in this section is deemed to have been committed at either the place where the communications originated or at the place where the communications were received.

C. Any person who violates this section is guilty of a class 1 misdemeanor.

Well, guys, I hope you don't offend anyone from Arizona in the near future. Because you would then have committed a crime in Arizona.

This is such a great piece of legislation.

Addendum: in responding to my comments, I would suggest that you not disturb my peace and quiet through repeated (read: more than one) posts. That will be all.

Have you paid attention since 9/11? America doesn't care what the constitution says.

Nah, that only applies if you can tangentially link the law to terrorism, or there is a business backing it. Random laws from random lawmakers still get shot down.

Well, at least in most of America. This is Arizona, after all.

I'm in favor of limiting trolling. The problem with our site's ToU is that it's too vague and enforced poorly a lot of the time, but in principle I like the site having a ToU.

Getting the government involved for this is ridiculous, though. Forums should handle their trolls on their own.

Intent to terrify.

And then of course you would be strip searched upon your arrest.

It's pretty much bullying. Lighthearted trolling is fine, but some people take it too far. I'm against anyone mistreating someone unfairly, especially people who have problems in the first place.

But when you were bullied as a kid, you went to the teacher. You didn't go to the police to have the bully arrested.

Online bullying rarely goes that far, and in the couple of huge cases I know about that it did (Jessi Slaughter and Megan Meier) both girls had severe problems before anything happened. While I dislike major trolling for the most part, I'm not sure where in the law it says you're required to be nice. People don't go to jail for being jerks. If you didn't know, Jessi Slaughter is the "you dun goofed" youtube girl (that meme turned into a really sad story btw.) and Megan Meier is the girl who killed herself over a "friends" moms fake myspace profile. In fact, if I'm not mistaken, her suicide led to many poorly written and hastily made bills... probably much like the one Arizona is trying to pass.

Seriously, if people could write like death notes through email I'm sure there'd be a lot more cases of this going around.

Anyways, another major problem is that law makers are trying to apply real world law to the internet, which does not work. If it's just trolling, it's not even a real law. Even honesty is not required by law all the time outside the internet, so why should someone internet trolling (dishonest or honest) be punished?

By the way.

I told you people this anti-bullying push would lead to crap like this. No matter what anyone says, so long as they don't call for violence they have a first amendment. You either defend free speech or everyone loses it.

First Amendment doesn't really apply due to ToS, etc. But yeah pretty much this. The bad kind of free speech(hate speech for example) beats no one being allowed to speak their mind. Something should be done but oh man, talk abou misguided....

That mom IS still in jail right? Because I remember reading that and was unable to see her as anything other than a monster. But yeah, blame people like that for all of this ****.

The funny thing is that most trolls think they're not doing any harm or even better think they're some sort of "defender of freedom", but their actions are now causing stuff like this to happen.

Truth be told, trolling won't stop. It's just The Law's turn to troll.

Internet "bullying" is a joke. The only reason that bullying happens IRL is that it is unavoidable. The person being bullied is unable to avoid those bullying him(lives in close proximity to the bully or attends the same school), or he would. Internet "bullying" on the other hand is easily avoided. It's called don't go online lol
