He should get 20 years in prison, he's not innocent in this.

He lied about his abilities and also knew the brakes were bad yet he still choose to continue on.

Every driver does a self check list before leaving. They routinely do it alone. Much like how Uhaul has customers sign off on the damage to the truck before they take it out. Once you sign off, the liability is yours.

So what you're saying is, it is completely normal for companies to take shortcuts in place of safety.

Do pilots do a self check list before taking off? No? Didn't think so. Trucks are just as dangerous as airplanes. It should not be solely the driver's responsibility to ensure the truck is safe, let alone a driver that did not receive proper training or safety evaluations from the job itself.

But they are not the sole person responsible for checking the plane. They literally have people whose job is to specifically make sure the planes are okay.

Sounds like the trucking industry needs these job opportunities to avoid future unnecessary deaths. They won't though, because it costs money.

Or maybe people should just stop lying on applications in jobs that could lead to someone elses death?

They do... and if anything goes wrong the captain is on the hook. They could be sued or even go to jail if something goes wrong on their watch, besides just getting fired.

Maybe companies should realize that our society encourages people to fudge their resumes so they can put food on the table and get adequate health care? So just in case, provide basic training and regular safety tests?

No. The choice is prison and you want to make the choice for someone else. You say giving a choice of being in prison or having a body chip is not a choice someone can make because you want prison to be the only choice. I get it now. You feel accomplishment in calling stuff names.

I'm wondering what exactly the people who want him to serve 20 years in prison hope to gain out of this

Doesn't seem like he acted maliciously, just made some incredibly dumb decisions that resulted in a tragedy, but people that get out of long prison sentences aren't suddenly incapable of making dumb decisions so what's the angle here

Um, actually he is at fault since if he'd done a proper pre-trip inspection like every trucker is supposed to, he'd have known the truck wasn't in safe condition.

The sentence is bullshit, the company should be held accountable as well, but don't claim the driver didn't fail to do part of his job. Especially when some states, Maryland be the first to come to mind, include the pre-trip inspection on the CDL test.

YEah, look up the Ghimli Glider incident. Captain didn't properly verify fuel load, ran out of fuel, and despite performing a landing that was impossible for everyone that did it in simulation, was fired for his fuck up.

And anyone who thinks this refusal to enter Colorado will last doesn't understand that trucking is like any other job. Can the owner-operators keep not going into the state? Sure, most of them may even stick with that. But the guys working for Schneider, Swift, and other companies will get a choice of "go where we say you're going, or we'll get someone who will." Freight will keep moving into Colorado.

It's not part of Texas as far as I know. My father went down there to get his CDL back after letting it lapse. That wasn't the primary reason, but whatever. Either way, the guy probably knew what a pre-trip was and that he was supposed to do one.

AND places with really long inclines tend to have a spot where you're required to stop and check that your brakes are in adjustment.

And why didn't the driver apply the compression brake to use the engine to slow down?

You missed the part where there's a driver shortage right now in this country. Companies can't afford to fire drivers.

Traditionally this might be true. But as someone who has long worked in an industry with a similar mentality, trucking companies are not going to fire anybody right now. There are so many driver positions available that any trucker fired by a company for refusing to go into Colorado will have another within a few days. It could actually create further backlash by the drivers against the company itself. For the first time in the decades since Reagan workers are realizing that they have the actual power and are beginning to use it.

I meant trained to use it during his CDL licensing. It's kind of a fundamental part of truck operation. Anyone that is issued a license without knowing about exhaust/compression release brakes shouldn't be behind the wheel.
