I don't know the context of this particular case, but that is how prosecutors get witnesses to testify all the time.

The issue is that the D.A. prosecuted a case in a way that he knew would get overturned just so that he would get reelected.

Or he's just been encouraged by someone in Cosby's camp to "remember" an agreement that was made orally, and very curiously not put in writing for some reason.

I think it was basically: We don't have enough evidence to make criminal charges stick, so agree to a civil plea bargain and pay $3M and we'll give you criminal immunity.

Then they found more evidence and filed criminal charges, but he had criminal immunity so he's going free now.

How does double jeopardy work? Can they not take you to trial again if they find new evidence?

Probably because the DA thought it would be better to get his testimony for a civil case than attempt to convict him criminally without his testimony? Ultimately, he did get Andrea Constand $3M dollars

Kinda my thoughts.

Dude is 83 years old. Being in a cushy prison cell isn't really going to be that different than just being in his cushy house or retirement home or whatever. Really just saves the prison system money basically.

I mean it's kinda just dumb on principle but yeah

From what I can tell, this isn't a shortcoming of the American legal system. It has its own problems to be sure, but the prosecution fumbled this.

The grossest thing about this situation (besides him going free of course) is the prosecutor (and others) trying to put any blame for this on the court when this is 100% on the prosecution.

While I cant fault the court here, that deal should never have been allowed to happen. Providing criminal immunity for rape for testimony in a civil case is absurd. Fuck Cosby, and I hope he has a miserable remainder of his life.

On the one hand yeah, he's super old and it's not like he was going to spend his final years as an active sexual predator...

But on the other hand the optics here are terrible and they reinforce that if you are wealthy/famous enough you actually can get away with anything.

It's just a sad reflection of the system.

I mean, this had literally nothing to do with his wealth/fame and everything to do with the prosecutors being dumbasses.

To be fair, there are tons of cases where prosecutors are dumbasses and get away with it because the defendants are too poor to higher fancy lawyers.

The article says the sentence was three to ten years. He's two months and change away from his 2018 conviction. He's more or less served the minimum sentence and his brand is irreparably damaged. There's not much more you can do to him except let him die in prison, and really, what difference would that make?

He wasn't convicted for serial rape, he was convicted of one rape. You can only place a sentence on what the prosecution manages to get a conviction on. Blame the statute of limitations in whichever states for the rest of them.

The US still probably has the best justice system in the world (philosophically speaking). I'd much, much rather live in a place where criminals get off than where innocent people are imprisoned.

And the US judicial system is kind of designed to skew toward the former.
