A former waitress in Brooklyn says that her uncertainty regarding the COVID-19 vaccine cost her her job. Bonnie Jacobson worked at the Red Hook Tavern, who she said asked her last week if she planned on getting the vaccine after it had been extended to restaurant workers. "I was honest, I'm not going to do it quite yet," Jacobson said. "I do have my reservations about it, I need to talk to a doctor, just see how I feel. She said no problem." Jacobson emphasized that she was not an anti-vaxxer, but rather has been planning and trying to have a child for about a year. She said she was concerned that getting the vaccine would delay her hopes of having children even further. "My husband and I just got married, and were planning on starting to try to have children in August," Jacobson said. "It's already been postponed, I would hate for something to happen and me get the vaccine and we have to hold off a few more years." She said that the restaurant initially told her getting the vaccine was not required. But just days ago, she said the tavern changed course, telling her in an email she received Monday that they respected her decision but "we have implemented this policy to maintain a safe working environment." The email to Jacobson then stated that getting the shot was mandatory, and that "at this time your employment will be terminated. We are sad to see you go."

Jacobson said she was stunned by the move. "I was just like wow, really? I worked for you through a pandemic. We've been 100 percent outdoors, I've been working in the heat, in the cold. I just worked a 13-hour double on Sunday, Valentine's Day," she said. But the firing appears to be completely legal, as companies can fire employees for not getting the vaccine. The move highlights the difficult dilemma employers now face trying to ensure workplace safety, even as some workers want medical autonomy. "I'm not out for a lawsuit. I'm not out for money. I think it's an important story and I think people should know about it," Jacobson said. "I do think employers should think twice before treating people like this." Jacobson said she isn't trying to get her job back either, saying that she no longer wants to work at the restaurant after being let go.

If the employer wasn't providing its workers with inside access to get vaccinated and was left up to them to figure it all out especially in her specific life situation, then she's absolutely allowed to sue them for this for a fuck ton.

Yall clearly didn't read her reason why. She was trying to get pregnant and wanted to tall to her doctor if it would affect the pregnancy before she got the vaccine. She was also told it wasnt mandatory and management seemed fine with her decision. Then they just fire her without telling her the policy became mandatory. She had no time to get her affairs in order or warning that she could be fired for it.

I see stuff like this and think it's always fucked up when even the military isn't requiring people to get the vaccine (and we normally have to get everything), and private businesses are pulling shit like this.

I can kind of understand their logic if they're not able to serve outside now for the season, though.

I doubt much testing of the vaccine was done on those who are pregnant and she is worried, but at the same time, working in the service industry really should be vaccinated if possible.

i'm confused. didn't cons fight for the right for businesses to to run how they want, serve who they want, and hire/fire who they want? if they're ok with businesses refusing to serve gay people, or firing a worker because they dont like their hair style, i cant understand why they'd be upset when a company fires a worker who categorically refuses to vaccinate.

I'm torn on this.

On the one hand, she's in a job where she absolutely should be vaccinated, and I'm all for employers telling their staff that they have to be vaccinated if they're to turn up for a shift. The thing about it possibly preventing her getting pregnant sounds like a weird angle for her to take, too - I've not heard anyone suggest this could be an issue.

On the other hand, it's bollocks for them to change their policy then dismiss her immediately. Surely they should give a warning period that their rules have changed, even if it takes the form of "you can't come back to work until you're vaccinated, and if you're not vaccinated by x date we'll terminate your employment." You can't fire someone for not following a rule that didn't exist moments before - it's like sacking someone for having dyed hair immediately after introducing a "no dyed hair" policy: give people a chance to rectify it and comply.

Where I live, I can't even get the vaccine yet and I'm exposed to hundreds of customers every single day. She was never given adequate time to do so. If I were her, not only would I attempt to sue the business into the ground which I think a good lawyer would be able to do, I'd also make sure to blast the business on Social Media.

Yeah, if she refused to get one after being told she had to then I'd have no issue. But that's not what happened here and seems like them being a little too zealous.

Just let her know she needs to get one, and if she refuses at that point then you fire her. Obviously giving her time to speak to her doctor I guess.

Well the right thing for her to have said, is that I need to speak with my doctor first. No additional info about planning to get pregnant. With employers you have to choose you words wisely and not offer additional info if they dont need it.

The issue, which you are well aware of despite your attempts to appear ignorant, are that they gave her no chance to get the vaccine before firing her. If she'd refused after telling her it was required, then I doubt many would care.
