Most people typically associate the term "rape" with it being a violent act or forcing someone to have sex against their will.

As far as reports have detailed, the case involves neither conditions. There was no violence or force involved. It could be argued that it's a case of deception, which I agree it fits the bill. However, deception is not forcing someone against their will. It's deluding them into making their own choice. It's not force or an act of oppression. It's trickery.

Arguing that this is rape is a slippery slope, because many other common place scenarios would than also qualify...such as a woman lying about taking birth control while having sex with a man who clearly does not want to support a child and she later surprises him with a baby she expects him to pay for. Under the idea of "rape by deception", such a woman would qualify as a rapist because she tricked someone into having sex with her under conditions they did not originally agree to.

In other words: a typical female golddigger trying to lock down a wealthy man by tricking him into getting her pregnant would now qualify as her raping him. Keep in mind, this is not a rare ambition today...

Trans people who avoid revealing their trans status could also fall under this broad precedent if their intended sex partner finds out they have been deceived.

I'm personally for punishing violent or coercive rape, but tackling the nebulous term of "deception" can be far more arbitrary and have much broader unintended impacts when recklessly treated the same as cases of violence and coercion. Because what could count as deception?

Many common place things that the average men and women would not consider a sexual offense...

One of the rape by deception cases in that wiki article is from one woman against another woman, because the rapist woman was presenting herself as male. If the raped woman had known the rapist woman was actually female, she wouldn't have consented.

Pretty sure it's deception if the other person has made clear that they won't engage in sex with transgenders, but doesn't ask a person beforehand in particular even if the other person knows of the former's position.

And opposite experience happened with a mate of mine, many years ago with his (then girlfriend.) He relied on her taking birth control pills as he couldn't be bothered with wearing a condom and the following morning after having sex with her.

She lied to him that she took birth control pills before they began as to get knocked up by him and he was forced by this to take responsibility to marry her and be a Father and a provider for his family.
