It really depends. If they were jaywalking on the highway -- where pedestrians have no right to be at all -- the pedestrian would be 100% at fault. Otherwise blame tends to be assigned in portions (especially for civil matters) and there are certainly mitigating factors. In general, though, more fault is put on the driver in most cases.

So many variables. Like if a jaywalker came out of nowhere in the middle of the night, with no street lights, wearing dark clothing, obviously the driver isn't at fault. But if it's like in the middle of the day, in a pedestrian heavy area, the jaywalker was wearing bright clothes, and the driver was supposed to be watching and going slow enough to stop, that can be a different situation. :P

If the driver is following all traffic laws within the area then the jaywalker is at fault. At least from the standpoint of law enforcement.
