Harvey relief funding is going to be smooth and bipartisan, coming at the same time as tax reform?

I doubt it.

On the topic of the Arpaio pardon:

Before I start, this is only based on what I heard in a presentation given by an intellectual property and constitutional lawyer today.

The pardon of Arpaio may not hold up and may actually be outside the jurisdiction of the presidential pardon. According to the constitution, the presidential pardon only covers criminal convictions, Arpaio's conviction was not technically criminal in the same sense as a murder conviction would be. It may be called "Criminal" Contempt of Court, but it is entirely in the purview and jurisdiction of the Judicial branch because the offense he was convicted of was against the court, not the constitution and therefore not the "state" as normally referred to. He wasn't convicted of breaking a law, but of being in contempt of the court. Punishment for being in contempt of the court is only in the jurisdiction of the court. The other two branches of the government do not have jurisdiction in this case, and therefore the presidential pardon is not applicable.

There is a non-zero chance that we may see the first over-ruling of a presidential pardon in the history of our country.

Huh. Very interesting. I knew that the 'crime' was contempt of court, but I didn't realize that that could limit the presidential pardon.

Is there much case law for governor pardons being overruled?

I don't know, the lawyer just used that particular incident as an example of different types of law and jurisdiction

Also, I guess I should have specified "presidential pardon"

Did we get a number on how much money Donald makes from the Secret Service staying at his properties? I think there was $16,000 just from golf cart rentals.

Donald's donation makes for a great headline, but I'm in no hurry to thank him when he's taking government money like this.

Yeah, unfortunately I can't give the benefit of the doubt here.

There was that instance where when reporters checked on his claimed donations to veteran's groups they reported they got nothing and when they went to the campaign, the checks got written like that day (as in the day the reporters asked about it, well after the claim of donations were made.)

Plus stuff like the donating his paycheck to the parks or whatever... when the amount was dwarfed by the amount their budget was cut.

I mean, if the donation is actually made, that's great, but it's just sad that I feel like actual reporting will need to be done to follow-up and confirm it actually happened.

Oh, way late but since it was asked, I don't think the HFC will fight Harvey relief spending (and cynically I actually think that it occurring in Texas and under a Republican President are a factor here, see Sandy) however I expect them to try and play games with it like tying the spending to cuts in PP or The Wall or something like that so they can try and blame any Democrat who votes against it.

Two sources familiar with the situation told Politico, which first reported the story, that Clarke is expected to join the Trump administration in a position that is not Senate-confirmed. The former sheriff told Politico that he would “talk about my future plans next week."

By all accounts, the head nurse at the University of Utah Hospital's burn unit was professional and restrained when she told a Salt Lake City police detective he wasn't allowed to draw blood from a badly injured patient.

The detective didn't have a warrant, first off. And the patient wasn't conscious, so he couldn't give consent. Without that, the detectivewas barred from collecting blood samples ?not just by hospital policy, but by basic constitutional law.

Still, Detective Jeff Payne insisted that he be let in to take the blood, saying the nurse would be arrested and charged if she refused.

Nurse Alex Wubbels politely stood her ground. She got her supervisor on the phone so Payne could hear the decision loud and clear. "Sir," said the supervisor, "you're making a huge mistake because you're threatening a nurse."

Payne snapped. He seized hold of the nurse, shoved her out of the building and cuffed her hands behind her back. A bewildered Wubbels screamed "help me" and "you're assaulting me" as the detective forced her into an unmarked car and accused her of interfering with an investigation.

For now, Wubbels is not taking any legal action against police. But she's not ruling it out.

"I want to see people do the right thing first and I want to see this be a civil discourse," she said Thursday, according to the Deseret News. "If that's not something that's going to happen and there is refusal to acknowledge the need for growth and the need for re-education, then we will likely be forced to take that type of step. But people need to know that this is out there."
