TDS still owns it, and any action to take it from them would be a be civil violation that would almost certainly be ruled in favor of TDS. However, since GoDaddy also provides hosting for sites themselves, in addition to just acting a registrar, they are allowed to pull the plug for TOS violations. With that said, this probably doesn't mean much in the long run.
