The Supreme Court ruled on Monday that evidence found by police officers after illegal stops may be used in court if the officers conducted their searches after learning that the defendants had outstanding arrest warrants.

Justice Clarence Thomas, writing for the majority in the 5-to-3 decision, said such searches do not violate the Fourth Amendment when the warrant is valid and unconnected to the conduct that prompted the stop.

Justice Thomas’s opinion drew a fiery dissent from Justice Sonia Sotomayor, who said that “it is no secret that people of color are disproportionate victims of this type of scrutiny.”

“This case tells everyone, white and black, guilty and innocent, that an officer can verify your legal status at any time,” she wrote. “It says that your body is subject to invasion while courts excuse the violation of your rights. It implies that you are not a citizen of a democracy but the subject of a carceral state, just waiting to be cataloged.”

Yea I'm not for that at all. I feel like if they had a valid reason like public safety and could obtain the proper warrants it's understandable. But they can do it to anyone right now. That's scary. I'm not doing anything wrong online for example so it won't affect me but that doesn't mean I'm ok with it.

On the one hand the 4th amendment should be protected and no liberties should be taken with it.

On the other hand I'm assuming the logic...

Illegal stop, runs persons name finds separate warrants performs the search enforcing the other warrant.

A new crime and the search wouldn't be valid but 5he cop is just enforcing an already standing warrant and that's the probable cause for the search.

You can't tell a cop he can't enforce a warrant. I don't know what a good way to handle situation.

I didn't read the article was assuming it was referring to body searches. I wouldn't think an arrest gives you the right to search a house. A car however it usually does. They can't search it exactly but they technically do because they inventory the car prior to towing which works out the same as a search.

You can't search a house after arrest without a warrant and they said illegal stop so I'm thinking a driver or pedestrian in which case the search would be on the person or on the car (although again the car is inventory)

They don't search your car after an arrest without a warrant. It will however be inventoried to make sure nothing of yours is stolen before towing. The effect is the same but definitely not illegal.
