This whole debate started over the shaman.

Yes, he didn't physically attack anybody directly, that we know of.

But the guy was with the group that clearly had violent intentions. And he was carrying a spear. And was photographed menacing somebody with said spear. And left a death threat on Pence's desk.

Was he one of the worst? No. But "non-violent" isn't exactly what I'd use to describe him. "Idiot," yes.

The people that stayed outside? Non-violent. The people that wandered in after the breach and didn't do anything? Non-violent.

But if you were part of that breach, you were violent. It's not just "a few."

I thought Deepspraw was one of our known conservatrolls and thus the implication was of course he agreed with the mostly conservative viewpoint of "nothing happened it was just a protest."

The reason I disagree on the framing of the events (that it was just a protest gone wrong) AND agree that the sentencing of the Shaman was too much is because there WAS a coup attempt, there WERE people that intended to break in and commit violent acts, and that much was clear. I disagree with "it was a protest" because of that. When it comes to the Shaman, he DID choose to go along with the violent people breaching the capitol, but whether he was part of the coup/what his actual intentions were is questionable at best, because he wasn't armed and didn't actually attack anybody. This is why I say he's guilty, as he didn't stay outside and chose to take part in the actual breach, but he's not "41 months guilty" because there's no proof he was actually a part of the coup attempt itself. I put him above "idiot along for the ride" level because he didn't just meander in after, he was right there with the people that clearly were intending violence, but he clearly didn't come prepared like they did, so it's plausible he just got swept up in it. He's worse than the people that stayed outside or just walked in after and didn't do anything, but he's not as bad as the people that actually planned (poorly) for a coup.

Most states attach it to the plea, similar to pleading insanity and so on. I'm not sure if most states actually make it like, the official wording (like "not guilty by reason of insanity/self-defense/etc."), it's possible it's just listed as "not guilty," but it's part of the plea. It's part of the plea so that the prosecution can prepare their case accordingly and so the defense can present evidence accordingly. It's the difference between an affirmative defense and a standard defense.

EDIT: The point is, whether it's officially listed as part of the plea or not, an affirmative defense must be plead prior to the case starting, hence why it's the "first move."

The defense "goes first" in that they plead self-defense, which is what the prosecution then has to disprove with their case. The whole point is the defense doesn't have to prove their plea, they just make said plea and it's up to the prosecution to prove why it's not self-defense. The defense does not have to prove it is.

That's part of it, but within the bigger scope of the prosecution has to prove their case, not the defense. If the defense is claiming self-defense, it's not on them to prove it. It's on the prosecution to prove it wasn't self-defense. Obviously the defense works to discredit/show why the prosecution's case is wrong, but that's still in the scope of the prosecution having to prove their case, not the other way around.

No, that's not how it works. When you plead self-defense, it's still the prosecution's job to prove why the claim doesn't work. They have to prove, without any doubt, that the use of force was not necessary/justified. In this case, they're making the defendant try to prove, beyond a shadow of a doubt, that there's no way it wasn't justified. That is not how it's supposed to be. It's the prosecution's job to prove the defense wrong.

40% seems very high. I'm a casual player and I didn't know about the glitch until I read about it in this topic just now. I'd say it's probably closer to <10% than 40%, because I'd guess a vast majority of players don't frequent forums about it.

So if you bought the double pack you actually paid twice for the same exact game, just with a single byte difference. Making it probably the most expensive byte in the history of home consoles video games history

I know the difference between versions was always minimal but this time it actually feels worse

This is literally the way it's always been, they've just been doing it less efficiently.

The games have always been the same, they just made two separate builds/releases, one with an A flag, and one with a B flag.

This is just more efficient. One build/release with a C flag that has an "If A, then A, else if B, then B" statement in it.

People were for some reason under the impression that they made the same game from the ground up twice, which has never been true.

Datamines and leaks actually showed the music was placeholder, and the actual music is rather good. They also revealed There's stuff like gym leader/E4 rematches with Platinum teams and teams that are 6 pokemon, fully EV trained, with actual good movesets, and a pretty neat way to get old legendaries, among some other small things. Nothing huge, but more than expected.

Absolutely, because it's still considered being "terminated."

People have successfully won lawsuits to get their children reinstated on to school sports teams before, or just plain won settlements for them being kicked off in the first place.
