Most lawyers won't file a lawsuit they know they can't win, unless they know their client has enough money to pay their bills without a settlement; otherwise, they're just throwing away cash. I'm not convinced someone as dumb as this Karen has enough money to meet that requirement.
I think these guys are hoping that Starbucks decides to settle out of court. A lot of big companies are willing to do that, because a settlement is cheaper than paying their own lawyers to fight the case all the way to a trial's conclusion. That being said, I think it's a poor gambit in this case, because there's a solid chance that this case would get dismissed long before a judgement was rendered.
