As I recall, there wasn't even a motion to try to get that case before a different judge.

One is left with the question of what would have been different if the plan of record had been to deliberately allow all the Federal cases against Trump to go tits up.

You can't make a motion to DQ a judge because they're making rulings you dislike.

Please. The case for Cannon's bias was overwhelming even before she dismissed the case. After she dismissed the case, it was rock solid.

And even if the case agains the biased judge was doomed to fail because the system stupidly assumes all judges are incapable of being corrupt in this way, the attempt still needed to be made.

FFS, the documents case as a whole was a slam dunk against Trump, and it got pissed away without any real fight by the prosecutors whose job is literally to do that fight.

You can't make that motion for dismissing a case, either. There are remedies for that you can take. A motion to recuse is not one of them.

Look, as an attorney? I'm saying that sometimes there are reasons lawyers in the DOJ, or working for people sometimes do or don't do something. I am dealing with a case as we speak where someone pulled some HORRIBLY shady shit tht is probably going to end very, very badly. My legal remedies for this are very minimal atm and I have to suck it up.

A judge can be blatantly biased one way and still do things in such a manner that limits your options. If Cannon was making comments on the bench how much she loved Trump, you'd have a basis. As it is, her rulings may be based in bad faith bullshit, but there are damn good reasons the law mostly prohibits recusing a judge just because you dislike their rulings. If you don't like how they rule and think it's against the law, your remedy is "appeal it."

"They;re OBVIOUSLY corrupt!" Okay. Prove it. I'm in front of judges who are very obviously biased at times. I can't just file a motion saying, in a nutshell, "this is devastating to my case" because those judges don't say anything to establish bias and it'd be my license on the line if i filed something going "I just know!"

Thanks. I suppose the election result mooted the appeal, based on the stupid idea that a sitting president is above the law.

And thanks for the other points as well -- sure judges shouldn't be getting booted from cases frivolously.

However, I do think there's a basic structural problem with how due process applies in practice in the US legal system, where the worst defendants in the world get off easy if they are rich/connected enough while people with less resources are often stuck with the "choice" between accepting a viciously unfair plea bargain or having a good chance of having their lives ruined in a trial.

So two things.
1. I don't pity Comey for this happening to him. His last second intervention in 2016 probably gave Trump the Presidency, and that is unforgivable.
2. Hopefully these charges get thrown out almost immediately with anyone playing along with this with a law degree facing disbarment. The rule of law and rights are for everyone, even for utter fools like Comey. By protecting them for him, we protect them for all. What is happening is clearly politically motivated.

I really want to defend him but I need more information. Could they send it to Anthony Weiner's laptop?

Dems thought it was some kind of moral win to have the guy who was denied a Supreme Court seat getting to run the Justice Department. They forgot that he was always meant to be a compromise, lukewarm candidate that could squeak by in a Republican Senate.

You are absolutely right. One of the big problems we have here is that people are too comfortable. They think that Democracy is this thing that will be here forever no matter what, even though it is crashing down all around us right now.

Folks in this country could stand to crack open a history book, or a book of any kind, or a newspaper, or a YouTube video even about history or world events every once in a while.

As I have written, it is a huge threat to Democracy that Comey is being indicted.

But also: Fuck this guy.

He is always going around acting like some patriotic paragon of righteousness. His at best ridiculous and at worst malicious actions are a big reason why we are in this mess in the first place.

This indictment cannot stand in a free society, but it doesnt change the fact that Comey is scum. And a windbag on top of it.

So apparently the prosecutor signed two indictments and gave them to the judge. One which appears to show no indictments were reached and one that shows the two that were given. Only the best people.
