In 2013 a judge ordered Jermaine Thomas to be deported but there was nowhere to deport him to because he is stateless. His father was born in Jamaica, his mother was born in Kenya, but Jermaine has never been to either country. His parents both emigrated to the US and met here. He was born in Germany at a US military base because his father was in the military. Because he wasn't born on US soil he didn't get automatic US citizenship and Germany does not give automatic citizenship to US soldier kids born there. His dad was a US citizen at the time of his birth, but not long enough for his children born overseas to get automatic citizenship. Jermaine has lived in the US his entire life (not counting the time as a baby in Germany he doesn't remember) and only speaks English. His parents were both immigrants, got divorced, my guess is he would've been a citizen if his parents went through the legal hoops and filled out the required paperwork but they didn't and a Texas judge ruled it's too late now. --- "Something's wrong! Contrary to belief U.S. bases overseas are not treated as U.S. soil. At least that was always a myth when I was in the military. Sounds like even though his dad was a citizen he hadnt been a citizen for 5 years or whatever the time requirement was at the time. Im also guessing they never filed the Consular Report of Birth Abroad and as far as Im aware you have all the way up to the point the child is 18 years old to do that. Most people do it right away at the embassy but you can wait until you get back to the states later if you want. Again Im only guessing but Im under the assumption they thought he was a natural citizen since the father was a citizen and in the military not realizing he didnt meet the time requirements for natural citizenship so they never bothered filing for Consular Report of Birth Abroad and none of this came to light until after he was grown and past the age of 18. Very unfortunate and yeah its shitty they care about deporting this guy now. The dude was raised American and lived in Texas most of his life. Thanks, archizzy, that clarifies things. So it's really fucked up that's he's not a citizen on a technicality. Then it gets so much worse when you read why he was arrested this year... Thomas says it all began with an eviction in Killeen, Texas, which is about an hour north of Austin. Thomas didnt know where hed go next, so to get things out of the apartment quickly, he says he moved all of the stuff into the front yard. Killeen police confirmed that he was arrested for suspected trespassing with no other charges. Thats a misdemeanor in Texas. He went to the Bell County Jail, where he says a court-appointed lawyer told him he could be sitting in a cell for eight months if he wanted to take the case to trial. After about 30 days in jail, which resulted in losing his job as a janitor, Thomas says he signed paperwork to be released with conditions. He was evicted and moved his stuff to the front yard. While trying to figure out what to do, he was arrested for trespassing. He couldn't afford bail so they told him he had to sit in jail for 8 months for his first appearance before a judge, so after 1 month he cracks and signs a plea agreement to get out of jail. That likely triggered the deportation process when they realized he wasn't a citizen but stopped when they had nowhere to send him. He also apparently was in jail 2020 to 23 for DUI and "harassing a public servant" and that last charge I have trouble believing after everything we've seen cops do.
