He's really flailing at this point. He must've decided to go full blown government is out to get me with his campaign. If this lands in the hand of a sane judge it should get tossed pretty quickly because numbnuts irrefutably had stolen government property there.

Three big questions:

1. On what grounds to get around qualified immunity shenanigans?
2. More importantly, what damages?
3. Most importantly, which of my colleagues is still stupid enough and desperate for clout to take on the DOJ?

It's not crazy to sue over due process and searches but this was done by the book.

Discovery will be his downfall.

The government spent years trying to get him to return classified documents he stole.

They only raided as a last resort, and even then, they didn't unlock an area that was locked.

The damages argument is easy. President, billionaire, business man, reputation harmed by illegal seizure. Calculating it isnt easy but as you know they dont have to try to do that until much later. They can just have a blanket $5 billion demand in the complaint.

For the third one, there have been, and will continue to be, more than enough attorneys willing to try. What better way to get your name out there.

The idea seems stupid because of the obvious discovery problems he would have to avail himself to.

Even though I pointed out how insane that actually sounds in the first place, he assured me that Obama was provided this benefit, Bush, Clinton and all presidents before them.

We'll see if the courts will indulge this farce of a lawsuit. Should be thrown right out, IMO.

He's actually going to have to claim at some point that the government had no cause to reclaim classified documents that had been requested more than once. That's flat out delusional.

Aren't civil and criminal courts typically conducted by different judges? A lawsuit would be civil. Cannon was presiding over a criminal case.

He is probably hoping for it to land on Judge Cannon's desk who will just be as biased in his favor as she has been in the sealed documents case

So the documents would of been worth only 100m to him, seem like a businessman could of gotten a lot more for the classified documents.

Being able to commit crimes and then civilly sue those who are victims or who investigate your crimes would be a hell of a cheat code.

I don't know about classified documents, but NARA had made exceptions for past presidents to keep documents (it's not just classified documents covered by the Presidential Records Act). Either way, NARA had to specifically make the exception; the POTUS doesn't get to decide what they can and can't keep and they can't defy NARA when they say they need documents returned.

Yeah, to think NARA would be cool with a former POTUS keeping the literal nuclear secrets of an ally nation is just a bridge too far for what would be acceptable. Keeping one's notes so they can use it for a book is one thing, nobody has justification to keep the nuclear weapon capacity of an allied nation. That's clearly something that's only retained to sell to a foreign nation. Literally serves no other purpose.

That combined with how awful his actions are is one reason he can only find really shitty and incompetent lawyers (i.e. Alina Habba) to take his case

He pays his lawyers when it's other people's money, which he's allowed to do with campaign funds and has been doing. That's why Rudy Giuliani got stiffed on the bill and the lawyers defending him in his recent cases weren't.

It's just funny because his lawyers are grifting him too. Like, they're getting paid millions of dollars to try and defend him in cases where his guilt is obvious, and the only reason they're doing it is because it's easy money.

Oh yeah, for his most recent lawyers I definitely think they're using him more than he's using them. I just get tired of the "he doesn't pay his lawyers" statement when the ones defending him for his current cases are paid ONLY BECAUSE it's other people's money. He has no qualms with paying others when it's not his money.

How does he keep finding lawyers willing to risk their futures filing his frivolous lawsuits?
