Democrats currently control the presidency and senate, which would allow them to appoint her replacement. This state of affairs may not be the case next year, or potentially for many years to follow.

Obviously because he doesn't want to and as much as we want him to be gone forever he's probably doesn't want to do that

Because he has no interest in helping Democrats out, and Sotomayor presumably does.

No way. She's younger than Alito and Thomas and seems to be far and away the most liberal justice. I understand that the court has now been politicized, but I don't think you should pressure a good justice to retire while they can potentially carry out 10+ more years of service.

Because he won't unless a republican is in office. This topic is in reference to republicans rat fucking an open seat to steal a supreme court justice, and postulating that Sotomayor should retire now so Biden could appoint a younger judge.

That said, nah, he's only 69 (nice) so she's fine for now.

You could get those same ten years out of a liberal replacement. Are her dissents really that much better than any possible replacement?

She's 69 and has diabetes I believe. Yes, probably best of she retires now and they get someone younger.

She should've done it earlier because now republicans would invoke the made-up "no appointments during an election year" rule.

Serious question: if she did retire, how likely would the current US senate (which includes 'Democrats' like Joe Manchin) be to confirm someone as liberal as Sotomayor? They confirmed Brown Jackson of course, but is she comparable to Sotomayor or is she only liberal compared to the likes of Gorsuch and Kavanaugh?

I think Manchin would be fine, but I think Sinema may go against the democrats as a final fuck you.

Of course she would, just to get that last little shred of attention as the door hits her in the ass on the way out.

Manchin would fuck it up

Sen. Joe Manchin, a critical swing vote in the closely divided Senate, said Wednesday that from now on, he will only vote to confirm nominees who have the support of at least one Republican senator.

Im going to be very honest with everybody, if my Democratic colleagues and friends cant get one Republican vote, dont count on me. You cant make it bipartisan, dont count on me, said the West Virginia Democrat who has announced his retirement that will begin in January 2025.

yea even if she wanted to resign now, she cant do it because of that. What republican will cross the line in an election year for a Supreme Court nomination?
