But Id rather it extend to all cases, not just drunk driving.

Unless They'd owe back child support that'd be kind of hard to do from prison.

How does that work? If they have assets before prison are they forfeit to the gov to pay? If they have no assets? And after 10+ years in jail it's unlikely they'll find a decent wage when they get out. Sounds like a good thing but will it actually do... anything?

It's a terrible law, WTF is wrong with all of you?

This law just made some victims worth more than others. A LOT more.

Now, someone w/ a BAC 4x the legal limit plowing into a 20 year old college student in a crosswalk going 70 mph in a 30 mph zone gets no fines beyond the prison time, and someone w/ a BAC 1.2x the legal limit that hits some 45 year old idiot (that has 6 kids) crossing the freeway w/o looking while going the legal speed limit gets hit w/ massive child support fees.
It makes the punishment no longer fit the circumstances of the crime and instead fit how much of a breeder the victim was.
Dear god do I hope the Supreme Court overturns this sick joke of a law!

So, the far more reckless drunk in my example is paying out hundreds of thousands of dollars to the family even though his victim was too young to have kids yet?
I didn't see mention of that, only whether the victim has kids or not.

Yeah, this sounds like one of those things that on paper is good, until Texas republicans start acting all Texas and republican to it. Waiting for some white highschool promising quaterback to get off with a slap of the wrist because they don't want to impact his potential future.

Why have any laws then if someone can potentially circumvent them?

Read the bill. Treats the driver as a judgment debtor. Not sure how Texas handles jointly owned property for purposes of enforcing judgments. Logistics seem half-assed and not well thought out.

If they're legally drunk, they are legally drunk. Doesn't matter if you are 4x or have a BAC of .09. You are drunk and have no business on the road. Period. The fact that "idiot" was crossing a freeway is a very moot point.

Not sure how I feel about this. I think the state should support all children that need it, whether they are orphaned, single parent, can't afford to eat at school, etc. If applicable, people who directly caused those situations should contribute as well, but shouldn't distract from the support of children in general.

I actually don't think he's necessarily wrong. Just his examples are pretty bad.

If you take Scenario A and Scenario B, and make everything 100% identical, except victim A has children, and victim B does not, it's kind of crazy to punish the offender *more* for something that wasn't an aggravating factor in the incident.

I actually would not be surprised if this law managed to stand up to a legal challenge.
