You can't see why someone on their way home from work wouldn't want to be harassed by a bunch of asshole cops unless they were drinking and driving? Do you get to go through a special line where they wave you through if you lick their boots first?

Or if you car smells like weed. At least in my city they can search your vehicle for probable cause if it smells like "fresh marijuana".

DUI checkpoints have been proven repeatedly and consistently to actually increase DUI related crashes and deaths. More people die and get hurt because of them. More people die than are saved. More people are injured than are saved. More property is damaged than protected.

Just something to think about.

sounds more like a checkpoint to ticket for lack of insurance/seatbelt/tags/ect. doubt they catch many drunk drivers at 5pm

cops really shouldn't be allowed to do roadblocks imo unless there is a dangerous fugitive on the loose

They did marijuana checkpoints where I grew up, in Baton Rouge. Everyone would line up in cars and a cop would literally randomly decide who they thought might have weed (Im sure you can guess how this was handled in the Deep South). If you passed the test then you dove off, but if you got profiled, they sent you into the nearest parking lot and search your car. They had judges on site to issue on-the-spot search warrants if you didnt consent to the search. That city literally had drive through daiquiris (liquor).

Leaving that place was possibly the best big change Ive ever made.

they're unconstitutional searches because they have absolutely no basis besides someone driving down the wrong road on the wrong night

Do you even know what the fourth amendment is. Just because you're on a public street doesn't make it legal for a cop to pull you over or search you.

Your city must have an issue with Afternoon drunks. Without getting into how I personally feel about stopping people before they have presented cause. DUI check points are a lot of a work. Cops are not known to do extra hard work for no reason. Thus it would seem to reason that this these stops yield a larger number of drunk drivers.

the majority of dui checkpoints dont search you though. they only search you if you give them a "reason" to and yes that reason can be questionable but thats a completely different case. getting searched during a checkpoint without probable cause is unconstitutional yes but the dui checkpoint itself is not and most checkpoints do not search everybody

It all depends on the state though. They are unconstitutional in Texas but legal in New Mexico.

A cop still needs reasonable suspicion to pull you over in the first place.

They can't (or at least aren't supposed to) pull someone over for no reason.

In 1990, the U.S. Supreme Court determined that, despite their intrusion on individual liberties, being stopped in a DUI checkpoint does not violate a persons Fourth Amendments protection from unreasonable searches and seizures.

I once had a cop tell me a can of soda in my car smelled like "dope". I'd gotten pulled over (literally in my driveway, on the way back from getting fast food) because my license plate light was out. He didn't search the car or anything but for whatever reason asked if he could smell that can.

When I told him no, it didn't, he just said it did again but that was kinda it. Just got a warning about the license plate light.

Kinda weird in hindsight. But yeah, I guess if he'd really wanted to it would have been that easy for him to search it, it'd have been my word and sense of smell against his.

yeah on the board i used to frequent there was a user who regularly complained that they had been stopped for driving drunk at a dui checkpoint because "i know better than them how capable i am of driving while drunk" to the point where he lost his license and got it back with a breathalyzer ignition start condition, and he started asking people how to cheat the breathalyzer because "lets be honest i would just find a way to drive regardless"

it was frankly very startling

and it became further startling when i saw similar sentiments on other boards
