Unless the accusation itself is a civil matter seeking damages but if tangible evidence is found (witness, DNA) then the state proceeds with charges? Part of it is what the other poster said but also it's a different burden of proof in civil matters. In civil court you only need a preponderance of evidence which basically is it more likely that it happened or not. To be convicted of an actual crime you need proof beyond a reasonable doubt.
