Absolutely not Only because of the video, though The reason they seemed to have won was because she said the food came without a warning In the video, it doesnt show her looking for a warning or anything. She immediately handed the box to the child Even with the warning, she would have done the same thing But I agree with McDonalds who said, High temperatures are needed to cook the nuggets adequately Though, Im still not sure how the nugget got lodged where it did

People tend to get bitchy if they gotta wait for their food. Just have the cashier say he it just came out of the fryer and call it a day. At bk we always told a customer if we had to cook something fresh cause we didmr have any already made. That enough should warn them it's gonna be hot

One I worked at you could ask for it "fresh" and if it was a burger we microwaved it. Anything from the fryer it got tossed bak in for like 15 seconds. What made me laugh is there was actually a thing in the receipt that would say "hot" next to whatever you asked to be cooked fresh

Solution: All customers must sign an agreement that says, "Hot foods are hot. I will be solely responsible for hot foods which are hot." before they can legally pick up an order. If a customer refuses to sign, they can stand in the "I cannot adult" waiting area and watch their order cool down to a reasonable temperature before picking it up.

Nuggets are cooked in a deep fryer at temperatures of 325-375F. If you're getting a fresh batch of nuggets right out the fryer, they can be dangerously hot. Same with fries. I've nearly gotten a burn from a french fry that touched the back of my hand.

For those who don't remember the details of the coffee lawsuit, a 79 year-old woman suffered third degree burns over 6% of her body and required skin grafts when she spilled an entire cup of coffee that McDonalds had served at nearly boiling (190F). She initially offered to settle for just the cost of medical expenses ($20,000), but McDonald's only offered $800.

I am sympathetic to the old lady: coffee is going to spill on people from time to time, container or not, and especially in a car. It doesn't need to be boiling/scalding hot.

Upon reflection I can be sympathetic to the kid as well: Happy Meal food is going to fall on kids at times. It can and maybe should be served lukewarm given its likely customers.

But I don't want to pay more to make my food lukewarm to protect adults from themselves. The packaging needs to be reliable/safe, but after that personal responsibility comes in. Sure, some adults are more functional than others, but the world has small dangers to navigate. If you choose to buy deep fried foods this is one of them.

Keep in mind that if we passed a law saying that fried food needs to be served at 150 degrees or less (or whatever) McDonalds would figure that out...but local businesses wouldn't be able to comply/buy the equipment nearly so easily and would be at that much more of a disadvantage. We don't hear these "got burned" stories when they relate to small businesses because they aren't behemoths, but there's no way it isn't happening even more often per capita with them given the lack of central policies/equipment.

I could go on forever, but no: food often comes from boiling water, ovens, flames, etc. It is hot. As long as the entity distributing the food takes reasonable and effective precautions (i.e. placing it in a reliable container) the consumer (or consumer's parents) are reasonable for eating it non-stupidly.
I haven't even read the case, but if they actually ruled against McDonald's that probably means McDonald's was repeatedly ignoring regulations.
