A federal judge in Wisconsin ruled Wednesday that a wrongful death lawsuit filed by the father of a man shot and killed by Kyle Rittenhouse during a protest in 2020 can proceed against Rittenhouse, police officers and others.
The father of Anthony Huber, one of two men shot and killed by Rittenhouse, filed the lawsuit in 2021, accusing officers of allowing for a dangerous situation that violated his sons constitutional rights and resulted in his death. Anthony Hubers father, John Huber, also alleged that Rittenhouse, who was 17 at the time of the shootings, conspired with law enforcement to cause harm to protestors. John Huber is seeking unspecified damages from city officials, officers and Rittenhouse.
U.S. District Judge Lynn Adelman on Wednesday dismissed motions filed by Rittenhouse and the government defendants seeking to dismiss the civil rights lawsuit.
In allowing the case against Rittenhouse and the others to proceed, the judge said that Anthony Hubers death could plausibly be regarded as having been proximately caused by the actions of the governmental defendants.
Rittenhouse attorney Shane Martin said in a phone interview that its important to note the ruling doesnt address the merits of the case, it only allows it to proceed to the next phase.

No kids, but I have a family member who I was extremely close with who stole and beat from one of my other family members and we've pretty much just cut them off from us. No idea where they are now.

I just couldn't let something like that slide.

I'm not neutral, I think Rittenhouse was in the right to defend himself, but at the same time this whole situation shouldn't have happened to begin with.

I feel like cutting someone off of of your own volition is a whole lot different than having that person killed.

I didn't say anything about murder, I'm talking about the lawsuit in general. That stuff costs money, and I myself wouldn't do the same thing in the same situation, which is the point I was bringing up.

1. The police absolutely let Kyle walk around with a weapon, gave him a water, and thanked him for being there. At first glance that seems pretty bad for them. But in court it was proven that Kyle was legally allowed to walk around with that gun. There was no legal reason for the police to just snatch his rifle. So what were they supposed to do exactly?
2. Anthony attacked Kyle with a skateboard, and what's even worse is that Kyle was running away when Anthony chased after him. Kyle wasn't advancing on the crowd, he was fleeing FROM the crowd. So what Anthony was doing wasn't fighting an immediate threat, he was attempting a citizen's arrest. He was trying to apprehend a fleeing suspect. Not only that, he was attempting to stop a fleeing suspect by using force. And we all know what murky territory that is lately.

This lawsuit has no hope.
