Sorry but I think that the officer had every right to arrest that man as he was breaking the law.

It is quite clearly posted that you can't eat or drink so why should that man think those rules do not apply to him.

As petty as it is. There is a Muni code(law) that states no food. If a subject is eating food there, then he is technically breaking a law there. That establishes probable cause for an officer to conduct a person stop on the subject. During a lawful detention of an investigation, if you are asked to identify yourself, you MUST identify yourself.

different places have different laws. IDs, birthday, name, social. Refusing to ID yourself would be whatever form of obstruction that city has a law.

He doesnt need an ID to eat a sandwich. Yes, its a dumb law

No see, it's completely different and justified because the cop who was called out for a more serious issue decided to power trip on a black guy who was minding his own business and not actually harming anybody

Sure the drunk woman he was called about might have been potentially violent or created an actual safety hazard on the train but this guy didn't show his ID

While it's very fucking stupid, that sign is there for a reason. If it says not to eat at the platform, why are you eating? He didn't get arrested for eating a sandwich, he got arrested for refusing to give his ID after he was confronted by a cop for not following the rules that are clearly displayed.

It's stupid, the cop overreacted, but the biggest idiot in this story seems to be the sandwich eater. How are people surprised when they are confronted for breaking rules? As far as I know, those rules aren't there for decoration.

Probably because he was being a piece of shit to the cop after the cop told him not to eat on the platform. Plenty of cops are assholes, but people are fucking horrible to cops as well. I'm sure if the guy apologized, stopped eating, or left the platform to finish whatever he was eating, none of this would have happened. Most likely the cop wouldn't even have asked for his ID. I'm surprised I even have to explain this to you.

I remember once, a dude took out a sandwich on the bus and took real big crunchy bites out of it. The lady next to him was like "damn you're really eating that sandwich". She gave him that look, like she wanted to be the sandwich. Then the bus driver told him to stop so he got off at the next stop and he was still eating the sandwich.

Needed identification to write a citation after the guy refused the warning to obey state law.

BARTs general manager, Bob Powers, said in a statement that eating in the paid area is banned and there are multiple signs inside every station saying as much and that the officer, who is white, asked the rider, who is black, not to eat while he was on the platform responding to another call.

It should have ended there, but it didnt, he added, explaining that the man did not stop eating and the officer moved forward with the process of issuing him a citation.

Mr. Powers said the man who was eating refused to provide identification and cursed at and made homophobic slurs at the officer who remained calm through out the entire engagement.

Am I missing something here?

The man was violating a law, the officer was going to issue a citation to the man for violating said law.

In order to issue the citation, the officer needs the identification of the offending party.

The man refused to provide identification, and was detained according to California Law.

I'm gonna have a very unpopular take:

I used to take BART everyday, usually arpund 5 am, and back in the afternoon. People trash that train with their food so much, and at some point I gave up on sitting (this was before the needles). Either woke up earlier to eat my food before going to the station or waited after my 3 hour commute to my destination.

I don't want to write up a picture, but a lot of people who did that really came with the mentality of being above everything, some being friends I grew up with.

Skip fare gates and stuff, don't be surprised if enforcement and price hikes kick in. BART and whoever is just trying to not have their spaces trashed for everyone to use. This guy sounds like a prime example. Breaking that simple law and then thinking he can protest it.
