OTB, they do find his rise to be curious, but they say the evidence is not conclusive enough to decide he cheated. They also said to take the "accuracy-based" reports with a grain of salt (such as the "he played "with 100%" precision x amount of times). Instead, they have a chess strength that is on a scale of 0-150 (of which a computer engine is at 150, and top humans are going to be at best, around 100 for a range of a few games). This goes back to 2020 by the way. What makes this serious is that these games were not "casual" online games, which cheating is still frowned upon by chess.com, but many would probably say the chess world is still more lax on online cheating since some still consider it to not be "real chess." The issue with the games he cheated on were that they were actual money-tournament games. Not only this, but this directly contradicts his statement of only cheating twice. We also see from this report, that, at least online, top-level cheating is prevalent. Chess.com reports only .14% of chess.com players cheat, but strangely enough, it appears 4% of FIDE top 100 have cheated, showing that this number only increases at this level by quite a bit (and dozens more GM's have been caught as well). As noted, OTB has no conclusive evidence of cheating, but they do say his rise has been a statistical anomaly compared to his peers (I only throw this out there because some of you all were like "that's not true, no evidence it was actually an anomaly!!!) Honestly, you all can still say he didn't cheat against Magnus and I don't think he did either, but Magnus was fully in the right to not want to face a known cheater. Additionally, Magnus calling out Hans has led to all these revelations in which it's obvious that chess needs to better fight against cheating. Cheating in chess is not just an all-or-nothing thing where you can tell someone cheated if they had 100% accuracy in a complex game, with moves that replicate stockfish. Top players typically will use engines to assist them, using them at key moments. Just getting help on one move from an engine could drastically increase your chances of winning. That's where the chess.com strength rating is used. If a player has an unusual strength rating in a span of games versus their normal strength rating, this will tip the staff that cheating may be happening. Even then, they have analysts go move-by-move to determine if the moves were unusual for a human to make, along with other things before officially deciding if a person cheated. Now, chess.com also functions as a business, and doesn't want to permanently eliminate their money-makers, so they typically will be very kind with the cheater, telling them that they can rejoin, along with having their titles and diamond membership still active on chess.com as long as they admit to cheating, agree to not do it again, and they are also banned from competing in chess.com tourneys for a year.
