Buzz has it that Clarry wants to repeal more laws but specifically not a case regarding interracial marriage.
How red would his face be if his own insolence provided them the precedence to do the thing they probably want to do anyways?

there's no reason to ban contraceptives, same-sex marriages, etc. (reproductive rights included) either, but repealing them are apparently now on the table

To be fair, they're perfectly comfortable hiding behind "It should have been left up to the states and it was overreach to ever rule on it at a federal level." That was their main legal justification for getting rid of Roe.

He never said he had any interest in making interracial marriage illegal. He said he would be okay with the courts leaving it up to the states for the sake of consistency.

Thomas is the ur-originalist. There's a good chance he'll find a justification for interracial marriage in 14th amendment, or a chance he'll state that marriage isn't in the constitution at all, and thus a 10th amendment issue.

There's quite a few churches that preach this and refuse to perform ceremonies for interracial couples, so definitely an argument that people can hide behind..
