Take Mike Tyson for example. He's a convicted rapist. Nevertheless, he's generally allowed to go about his daily life in peace. He like you is allowed to go to McDonald's and order a meal, despite everyone knowing he raped someone. But if he slapped the cashier, he's probably getting a lifetime ban from that McDonald's. How is the situation any different for Will Smith slapping Oscar's personnel? The Academy most of all cares about how they look. It's definitely a balancing act of trying to give the right level of punishment while also not rocking the boat too much.
